What Copyright and Platform Rules Apply to AI-Generated Videos Featuring Game Characters?

AI does not automatically clear a game character for use. Separate U.S. copyright and fair use from human authorship, publisher permission, platform monetization, and AI-disclosure rules.

Using AI does not by itself give you permission to use a game character. For a U.S.-based video, separate four questions: what protected expression from the game appears, whether you have permission or a defensible copyright exception, whether your own human contribution can be copyrighted, and what the publisher and platform allow. Monetization and AI-label requirements are separate from copyright clearance, and the answer can vary by game, platform, and how the video is made.

What copyright rules apply in the United States?

U.S. copyright generally protects original expression once it is fixed in a tangible form. It does not protect ideas, concepts, procedures, or systems as such. The U.S. Copyright Office’s What Is Copyright? guide and 17 U.S.C. § 102 describe that distinction.

For a game character, the important question is not simply whether the character is fictional or AI-generated. It is whether the video reproduces expressive elements of a particular character or game. A general archetype or idea is different from a specific character’s expressive depiction. The facts of the output—including what it depicts and how prominently it uses that expression—matter.

AI generation does not erase rights in source material. Nor does a creator’s lack of copyright in some AI-generated elements establish permission to use protected game expression.

Can you copyright your AI-generated video?

That is a different question from whether you may use the game character. In its January 29, 2025 report, Copyright and Artificial Intelligence, Part 2: Copyrightability, the U.S. Copyright Office said that protection for AI-assisted output depends on whether a human author determined sufficient expressive elements. The Office’s summary states: “The Office concludes that copyright protection in the United States is available only for works created by human authors.”

The report says that providing prompts alone is not enough. Human-authored expression that is perceptible in the result, or a sufficiently creative human arrangement or modification, may qualify for protection. AI-generated components do not automatically prevent protection for a larger work’s human-authored contribution.

Any copyright in your own contribution would not give you rights over a pre-existing game character. Keep authorship of your video and permission to use the game’s expression as separate questions.

Could the video be fair use?

Fair use is a case-specific U.S. copyright analysis, not a blanket permission for fan videos or AI content. YouTube’s fair-use guidance describes the four factors courts consider:

  1. Purpose and character: A video’s purpose and the nature of its use matter. Criticism, review, parody, or educational commentary may be relevant, but a stated purpose alone does not settle the question.
  2. Nature of the copyrighted work: A fictional character is part of expressive material; this factor can weigh differently than it would for factual material.
  3. Amount and substantiality: Consider how much protected expression appears and whether the video takes a particularly significant part. Even a short excerpt can matter if it uses the work’s “heart.”
  4. Market effect: Consider the effect of the use on potential markets for the copyrighted work.

AI generation does not automatically make a use transformative, and calling a video “fan art” does not establish fair use. Attribution and a “I do not own this” disclaimer do not create permission or, on their own, make a non-transformative use fair. The U.S. Copyright Office’s fair-use FAQ and YouTube both emphasize that outcomes depend on the circumstances. As YouTube puts it: “Ultimately, courts decide fair use cases according to the facts of each unique case.”

A platform claim or upload decision is not a court ruling. YouTube says it cannot decide fair use or mediate copyright disputes; a claim may arise even when a creator believes the use is fair. An upload remaining online, or being monetized, does not by itself establish that the use is lawful.

What should you check with the game publisher?

Permissions are game-specific. Find the official policy for the exact game and publisher rather than assuming that a rule for another title—or a general fan-content norm—covers your video. Check whether the policy addresses fan videos, commercial use, AI depictions, and any game assets you plan to use. If the policy does not clearly cover your intended use, do not treat silence as a license.

A publisher’s permission and a copyright exception are distinct routes: a license may authorize uses within its terms, while fair use is a legal analysis of the particular use. A platform’s monetization or disclosure rules do not replace either one.

How do YouTube’s game-content and monetization rules apply?

YouTube’s Video game and software content guidance says monetization can depend on the commercial-use rights granted by the game publisher’s license. Without an appropriate license, its guidance says game content should be minimal. It gives tightly connected step-by-step commentary with instructional or educational value as an example that may qualify; extended gameplay alone may not. These are YouTube monetization conditions, not a universal copyright license or a guarantee that a particular AI-generated video will be approved.

Do not carry those YouTube game-content conditions over to TikTok, Twitch, Instagram, or another service. The reviewed guidance does not establish equivalent game-content monetization licenses for those platforms. Check each platform’s current copyright and monetization rules separately.

When must you label AI-generated game videos?

YouTube’s disclosure guidance calls for disclosure when content is meaningfully altered or synthetically generated and seems realistic. A plainly stylized fictional scene may fall outside that stated realism trigger, but a realistic depiction or scene should be assessed against the current policy and upload flow. YouTube’s 2026 announcement says its single label format covers photorealistic and meaningfully AI-altered or generated content; the label itself does not change recommendation or monetization eligibility. A label is not copyright clearance or monetization approval.

TikTok

TikTok’s AI-generated-content guidance says creators must label AI-generated content containing realistic images, audio, or video. Its Community Guidelines describe exceptions for minor edits that do not change a video’s core meaning, including some minor retouching or effects. TikTok may also automatically label some AI content. Check the current rules for your content and region before uploading.

These are platform disclosure requirements, not a universal rule that every AI use must be labeled everywhere. The relevant trigger depends on the platform’s policy and the content’s presentation.

How should you assess a planned video?

Question What to examine What the answer does not establish
Do you have a license? Whether the exact game’s official publisher policy covers fan video, commercial use, AI depictions, and the assets used. Permission for one game does not establish permission for another, and platform approval is not a publisher license.
What is the video’s purpose? Whether it is commentary, criticism, education, parody, entertainment, or promotion, and how the character is used in that context. A purpose such as education or parody does not by itself decide fair use.
How much character expression appears? The amount, prominence, and expressive details of the particular game character shown. Using AI or changing the presentation does not by itself show that protected expression is absent.
How realistic is the synthetic depiction? Whether the output appears realistic under the specific platform’s AI-disclosure policy. A disclosure label does not authorize the underlying character use.
Where will you publish? The platform’s current copyright, monetization, and AI-disclosure terms. One platform’s monetization guidance does not govern another platform.

Use the answers to identify what still needs checking—not to predict a court outcome. If the project is commercial or the rights position is uncertain, consider getting advice from a qualified U.S. copyright lawyer about the specific game, output, and planned use.
