Crashes, No Sound, or Screen Glitches?

A free scan shows the junk files, broken settings and background clutter dragging Windows down - then fixes them in one click.Free scan · Windows 10 & 11If you mean a Nintendo game, the straightforward authorized route is to get it from Nintendo’s digital storefront or website; for Nintendo games made for phones and tablets, use Google Play or Apple’s App Store. A ROM site or peer-to-peer download is a different matter: Nintendo describes third-party copies as unauthorized, and whether making a copy from a cartridge you own is lawful depends on your jurisdiction and the method. “ROM” can mean the console’s read-only memory or, in gaming conversation, a digital copy of game data.
What do you mean by “get a ROM”?
People generally use the phrase to mean one of three things: download a game file, create a digital copy from game media they own, or obtain game files that their creators have authorized for distribution. Those routes are not legally interchangeable. The guidance below distinguishes Nintendo’s official channels and statements from broader legal considerations; your question does not specify a platform or country.
Where can I get a game legally?
Use the publisher’s authorized store
For Nintendo console games, Nintendo identifies its eShop and website as channels for authentic digital downloads. For Nintendo games developed for smart devices, it directs users to Google Play or Apple’s App Store. Availability depends on the particular game, system, and region, so check the relevant official storefront.
Look for files the rights holder has authorized
Some creators or publishers may distribute game files directly or permit a specific service to do so. Confirm that the rights holder authorized the download for that game and platform. The sources cited here do not establish a comprehensive catalog of licensed ROM files across platforms.

Are ROM-site downloads legal if you own the game?
Owning a cartridge or disc does not, by itself, establish that downloading a separate copy from a third-party site is authorized. Nintendo says downloads from peer-to-peer networks or links to third-party-hosted files are unauthorized copies, and states that uploading or downloading pirate copies of Nintendo games is illegal. That is Nintendo’s stated position, not a universal legal ruling for every country or situation. Nintendo’s Online Piracy page.
Nintendo Australia states that downloading a Nintendo ROM from the internet is illegal whether or not you own the original. Its guidance also says Australia’s limited format-shifting and program-backup provisions do not authorize copying Nintendo video games into another format. This is Nintendo Australia’s account of Australian law; do not treat it as a statement of the law elsewhere. Nintendo Australia’s intellectual property notice.

Can you make a ROM from a cartridge you own?
There is no jurisdiction-neutral yes-or-no answer established here. Creating a ROM duplicates game data, which raises copyright questions separate from whether you own the physical cartridge. WIPO explains that reproduction rights are implicated and says that, in most jurisdictions, making a ROM would infringe without authorization from the right holder. Uploading a copy can raise separate distribution or communication-to-the-public issues. WIPO’s report on the legal status of video games.
In the United States, the Copyright Office’s current rule includes narrow exemptions from the DMCA’s anti-circumvention prohibition for specified lawfully acquired games whose external server authentication has ended, when access is needed for local play, and for specified noncommercial preservation activities by eligible libraries, archives, or museums. These are limited circumstances; they are not a general personal-backup permission or a broad license to reproduce or distribute commercial games. U.S. Copyright Office, 37 CFR § 201.40.

Nintendo identifies game copiers and similar products that bypass security measures as circumvention devices. It warns that their use can raise legal concerns and may affect warranty coverage, functionality, or network updates. That warning does not establish the rules for every device or jurisdiction, but it is a reason not to assume that buying a copier makes a dump lawful or safe to use.
