Why did Nintendo sue over Switch hacking kits?
Nintendo of America filed its complaint against Ryan Michael Daly, doing business as Modded Hardware, on June 28, 2024, in the U.S. District Court for the Western District of Washington, case 2:24-cv-00958-GJL. Nintendo alleged that Daly sold mod chips, MIG Switch devices, MIG Dumpers, modified consoles, and related services, and asked the court to stop that activity. Those were allegations in the complaint, not findings that should be confused with the later judgment. Read the complaint.
What products were named?
The complaint named mod chips, MIG Switch devices, MIG Dumpers, and modified consoles, as well as services related to circumvention. In the later judgment, the MIG Switch is characterized as enabling access to unauthorized or pirated game copies, while the MIG Dumper is described as enabling cartridge copies to be stored on other devices. Did Nintendo win the case against Modded Hardware?
The case ended with a stipulated judgment in Nintendo’s favor. Filed September 5, 2025, it awards Nintendo $2,000,000 and imposes a permanent injunction. The judgment also provides for transfer of the Modded Hardware domain to Nintendo’s control. See the judgment terms.
What does the injunction cover?
The injunction bars Daly and specified associated parties from trafficking in circumvention devices, including mod chips, MIG Switches, and MIG Dumpers; modified consoles; and related circumvention services. Are Switch hacking kits still available?
The court documents establish the outcome in the Daly case, but they do not establish current marketplace availability for these devices. The injunction applies to Daly and specified associated parties; it does not by itself show whether products can be found elsewhere or determine their legal status in every jurisdiction.

Nintendo’s UK-facing legal-information page identifies MIG Switch/MIG Flash and mod chips as circumvention products. Nintendo warns that using them may affect a console’s warranty, system functionality, and online play.
