Nintendo of America was awarded $2 million in a stipulated final judgment against Ryan Michael Daly, who operated the Modded Hardware webstore. The September 5, 2025 order also permanently bars Daly and people acting with him from trafficking in specified circumvention devices and services, and requires the Modded Hardware domain to be surrendered and transferred to Nintendo.
What Nintendo won
The U.S. District Court for the Western District of Washington entered the joint stipulated final judgment in Nintendo of America Inc. v. Ryan Michael Daly on September 5, 2025. It awards Nintendo $2 million and imposes a permanent injunction. The filing says the parties stipulated to the order; this was not a jury verdict or a trial finding. Read the stipulated judgment.
What the case concerned
The judgment identifies the MIG Switch and MIG Dumper among the products Daly marketed, distributed, and sold. It describes the MIG Switch as enabling access to and play of unauthorized or pirated copies of Switch games, and the MIG Dumper as enabling users to copy game cartridges to computers or external storage. The order also addresses mod chips, pre-modified consoles, and modification services, and states that the conduct violated provisions of the Digital Millennium Copyright Act and copyright law. Nintendo’s June 2024 complaint had alleged that Daly ran Modded Hardware, sold circumvention products and services, and distributed unauthorized Nintendo game copies. Those were allegations in the complaint; the later stipulated judgment is the source for the agreed findings and remedies. See the complaint.

What the permanent injunction requires
The order bars Daly and those acting with him from offering, selling, promoting, distributing, or otherwise trafficking in covered circumvention devices and services. It also restricts related websites and requires the Modded Hardware domain to be surrendered and transferred to Nintendo’s control. The judgment allows covered devices and materials to be seized, impounded, or destroyed. The injunction and remedies are in the court order.
The court retains authority to enforce the order. The stipulated judgment states: “The Court shall maintain continuing jurisdiction over this action for the purpose of enforcing this Final Judgment and Permanent Injunction.”

How this differs from Nintendo’s $4.5 million case
The Daly judgment is separate from the $4.5 million default judgment against James Williams reported in September 2026. Williams was a different defendant, and that case involved online shops offering pirated Switch games. The Daly matter ended in a stipulated judgment; the Williams matter ended in a default judgment. Their defendants, records, procedural outcomes, and awards are distinct, so the $4.5 million is not an update to Daly’s $2 million judgment. Reporting on the separate Williams case.
A separate Dutch court ruling against a seller of Switch circumvention devices was also reported in September 2026. That proceeding took place in another jurisdiction and is not part of the U.S. case against Daly. Reporting on the Dutch ruling.
