Why Nintendo Sued the U.S. Government Over Trump-Era Tariffs

Nintendo of America challenged IEEPA tariffs in the U.S. Court of International Trade. A July 2026 order describes conditional relief for certain import entries, not automatic refunds for Switch 2 buyers.

Nintendo of America sued the U.S. government on March 6, 2026, challenging tariffs imposed under the International Emergency Economic Powers Act (IEEPA) and seeking relief for duties paid on imports. The complaint is Nintendo’s argument, not a court ruling that the tariffs were unlawful or an award of refunds. The case concerns Nintendo as an importer; it is separate from a later customer complaint against Nintendo.

Why did Nintendo sue the U.S. government over tariffs?

Nintendo of America filed Nintendo of America Inc. v. United States of America et al. in the U.S. Court of International Trade (CIT), case 1:2026cv01540. The complaint challenges IEEPA duties imposed through presidential executive orders and asks the court for relief. The CIT handles cases involving customs and international trade matters; the lawsuit is not a consumer claim brought by Switch 2 buyers. The court’s overview describes its jurisdiction.

Nintendo’s March 6 complaint alleges that the challenged measures had resulted in more than $200 billion in tariffs collected on imports from nearly all countries. That figure is the plaintiff’s allegation in its filing, not an independently verified total or a finding by the court. Read Nintendo’s complaint.

What has the court done in Nintendo’s case?

The docket report records a stay on March 9, a reassignment entry on July 14, and an order on July 22, 2026. Under that order, Customs and Border Protection (CBP) is to reliquidate certain entries without IEEPA duties: entries that had already been liquidated for more than 80 days and on which the plaintiffs made estimated deposits. The order makes that relief conditional on Nintendo’s counsel supplying importer identification numbers and CBP accepting CAPE declarations. It says the case remains stayed except as needed to carry out those directions. The available docket report was last retrieved July 22.

In customs proceedings, reliquidation means revising a prior calculation of duties on an import entry. The order’s more-than-80-day threshold applies to the category of entries it describes; it is not a general deadline for consumers to request money back. The docket report does not establish whether Nintendo received a refund or how much it may recover.

The CIT separately announced that CBP guidance on CAPE functionality for IEEPA refunds on certain entries was available, and that it issued an administrative order concerning new IEEPA tariff cases. Those court-wide notices provide procedural context, but they do not establish the outcome or present status of Nintendo’s individual case. Is this a lawsuit by Switch 2 customers?

No. Nintendo of America is the plaintiff in the government case. A separate complaint filed April 21, 2026, names customers Gregory Hoffert and Prashant Sharan and alleges claims concerning Nintendo customers and tariff-related consumer recovery. That complaint is directed at Nintendo, not the U.S. government, and its allegations have not been established as facts in Nintendo’s importer suit. Read the separate customer complaint.

The customer complaint describes Switch 2 as launching in the United States in June 2025 and discusses Nintendo hardware and accessories. That reference does not show that a tariff payment increased the console’s retail price, nor does it establish that a buyer is entitled to any repayment. The available filings do not establish tariff dollars attributable specifically to Switch 2 or a consumer refund amount.

What is known about the case’s status now?

The latest case-specific docket entry in the available report is dated July 22, 2026. It says the case remained stayed except as needed to carry out the order’s directions, but the report warns that a newer docket listing may exist. That record does not establish the case’s status on October 8, 2026. For the latest filings, the CIT identifies PACER as the source for case and docket information; see the court’s case-information page.

Neither the cited docket report nor the complaints establish that Nintendo ultimately received money back, the amount of any recovery, or whether tariff costs affected Switch 2’s retail price. Those outcomes should not be inferred from the separate customer complaint or from the conditional relief described in the July docket entry.
