New York Sues Valve Over Loot Boxes in Counter-Strike 2, Team Fortress 2 and Dota 2

New York’s Attorney General alleges loot boxes in Counter-Strike 2, Team Fortress 2 and Dota 2 combine payment, chance and items with value. Valve disputes that characterization.

On February 25, 2026, New York Attorney General Letitia James announced a lawsuit against Valve Corporation, alleging that randomized item containers in Counter-Strike 2, Team Fortress 2 and Dota 2 promote illegal gambling under state law. The complaint asks a court to stop the conduct and award monetary remedies. Its claims are allegations, not findings; no ruling is established by the available information.

Why is New York suing Valve over video game loot boxes?

The state’s case turns on whether Valve’s systems combine payment, chance and something of legally relevant value. The complaint alleges that players pay to open containers and receive randomly selected virtual items, and that some items can be sold or exchanged for money. New York argues that this amounts to gambling under its laws.

The Attorney General’s February 25 announcement named three games: Counter-Strike 2, Team Fortress 2 and Dota 2. The complaint says Valve’s Counter-Strike, Team Fortress and Dota franchises attracted “hundreds of millions” of players over roughly two and a half decades; that is the plaintiff’s allegation, not an independently verified player-count statistic.

How the complaint describes the loot-box systems

According to the complaint, a player generally needs to buy a key to open a virtual container. It alleges that some containers in Dota 2 and Team Fortress 2 instead require a direct payment. The contents are selected at random and are generally cosmetic, but the state says that rare items may command substantial prices through Steam’s Community Market or third-party markets.

The complaint also argues that the gap between common and rare outcomes, along with Counter-Strike’s animated opening sequence, makes the experience resemble a slot-machine wheel. It presents the systems as particularly concerning for minors. Those are the state’s characterizations; the complaint alone does not establish psychological effects, the prevalence of harm, or a court’s view of the games’ design.

What New York says the law requires

The complaint invokes Article I, Section 9 of the New York Constitution, Penal Law §§ 225.05 and 225.10, and Executive Law § 63(12). Its theory is that players stake payment for a chance to receive an item with value. Whether the randomized items have legally relevant value—and how their cosmetic nature and marketability affect the analysis—are central points of dispute.

The competing characterizations can be separated into the following questions:

  • Payment: Does opening a container require buying a key or paying directly? The complaint alleges that it often does.
  • Chance: Are the contents determined randomly? The complaint says they are.
  • Value or exchange: Can an awarded item be sold or exchanged, and does that give it value under the law? New York says rare items can command prices; the legal significance remains disputed.
  • Gameplay effect: Are the items functional advantages or cosmetic changes? Valve describes them as cosmetic, while the state’s argument focuses on payment, chance and value.

The Attorney General is seeking an injunction, an accounting of consumer losses, disgorgement or other equitable monetary relief, and fines or penalties. These are requested remedies, not amounts or outcomes awarded by a court.

What Valve says in response

PC Gamer reported that Valve disputes the gambling characterization under New York law. The company describes the items as cosmetic and compares mystery-box products to physical collectibles. Valve has also said it works to combat fraud, theft and third-party gambling-related misuse of Steam accounts and items. Those positions do not resolve whether the challenged mechanics violate state law.

In a statement reproduced by PC Gamer, Valve said: “Valve does not cooperate with gambling sites. To date we’ve locked over one million Steam accounts that were being misused by third parties in connection with gambling, fraud, and theft.” The account figure is Valve’s own reported claim, not an independently audited count.

Which lawsuit is this, and what is known about its status?

This is the New York Attorney General’s state enforcement action against Valve. It is separate from private federal litigation: Hagens Berman reports that three private actions were consolidated as In re Valve Loot Box Litigation in the Western District of Washington in April 2026. That consolidation does not establish the status or outcome of the New York case.

As of October 8, 2026, the available information does not establish a current New York County court ruling or procedural status. It would therefore be inaccurate to say that the state case is pending, dismissed, settled or decided. New York Attorney General Letitia James said in the February 25 release, “Illegal gambling can be harmful and lead to serious addiction problems, especially for our young people.” That is the plaintiff’s advocacy statement, not a judicial finding about these games.
