Tim Sweeney’s criticism of Apple and Google is about more than app-store commissions. Epic Games says the companies use control over mobile distribution, payments and app-store rules to limit competition. The outcomes, however, are sharply different: Epic lost its main antitrust case against Apple but won a narrower ruling on external-payment links; against Google, it won a jury verdict and an injunction that survived appeal, then reached a reported agreement with Google in 2026.
What Sweeney objects to
Sweeney, Epic Games’ founder and CEO, argues that Apple and Google have too much control over how mobile developers reach customers and collect payment. Epic makes Fortnite, operates the Epic Games Store and develops Unreal Engine, so the dispute is both a policy argument about platform competition and a commercial fight over Epic’s costs, customer relationships and ability to distribute its own store.

The criticism covers several connected practices:
- Store commissions: Apple and Google have charged commissions on qualifying digital transactions, with rates and programs varying by platform, developer, transaction and time. A 30% rate applied to relevant transactions discussed in the 2020 litigation; it should not be treated as a universal current rate.
- Billing rules: Developers have faced requirements or incentives to use platform billing for many in-app purchases. Epic wants more freedom to process transactions itself or use other providers.
- Anti-steering rules: Restrictions on links, messages or other directions to outside payment options can make it harder for developers to tell customers that another way to pay exists.
- Alternative-store friction: A rival store can be technically possible yet difficult for users to find, install or trust. Defaults, warnings, review rules and device-maker agreements can all affect whether it becomes a practical alternative.
In April 2025, Epic accused Apple of charging fees on outside purchases and using what Epic called “scare screens” and restrictions on third-party stores. Epic also argued that Google had comparable anti-steering problems under the EU Digital Markets Act. Those are Epic’s claims, not a blanket judicial finding that every policy at either company is unlawful. Epic’s statement sets out its position.

Those considerations matter, but they do not by themselves settle whether a particular restriction is fair or lawful.

How the fight began
On August 13, 2020, Epic added a payment option to Fortnite that bypassed Apple’s and Google’s store billing systems. Both companies removed the game from their stores, and Epic filed separate lawsuits. Epic had planned the move as a direct challenge to the rules—part of a campaign it called Project Liberty—rather than as an accidental breach.
That tactic made the dispute concrete, but it also gave Apple and Google a contractual argument: Epic knowingly violated store terms. The cases also involved different systems. Apple tightly controls iOS app distribution, while Android permits more forms of sideloading and alternative distribution. The Ninth Circuit’s account of the Google case describes the 2020 events and the surrounding distribution practices. The court filing is also the source for the historical figures below.
Apple: a limited payment-link remedy, not an antitrust win
Epic did not prevail on its central antitrust case against Apple in the trial court. The court did, however, issue an injunction addressing restrictions on developers directing users to outside payment options. That narrower result became the focus of further disagreement: Epic argued that Apple’s implementation did not adequately comply, while Apple challenged how far the injunction should reach.

So it is misleading to say simply that Epic “beat Apple.” Epic lost its main antitrust theory, but secured a remedy concerning external-payment links whose scope and practical effect remained contested. Apple and Epic were still fighting over the issue in 2026. TechCrunch’s May 2026 report covered Apple’s effort to prevent the dispute from reshaping App Store rules for all developers and reported that Fortnite had returned to Apple’s App Store globally except in Australia.
That return is significant for players, but it does not mean the underlying argument is resolved or that iOS has opened to alternative stores on the same terms as Android. A game can return to a store while its developer continues to dispute the store’s fees and rules.
Google: a stronger court result, followed by a negotiated deal
Epic’s Google case produced a substantially stronger legal result. On December 11, 2023, a jury found Google liable under federal and state antitrust laws in Android app distribution and in-app billing. On July 31, 2025, the Ninth Circuit upheld the liability verdict and injunction.

The injunction required Google to permit third-party Android app stores to access the Play Store catalog and to allow third-party app-distribution platforms through Google Play. The ruling addressed how defaults, agreements with device makers, warning screens and network effects could reinforce Play Store’s position even though Android allows some sideloading.
The court filing gives a sense of the historical friction: it says that in 2020 Google Play accounted for 95% of Android app downloads in the United States and more than 80% worldwide excluding China. It also cites evidence that 35% of users attempting to download Fortnite directly abandoned the process after encountering Google warning messages. These are figures about 2020, not current market-share or abandonment estimates.
In March 2026, GamesBeat reported that Epic and Google had reached an agreement that would let Fortnite return to Google Play worldwide and give developers lower-fee and alternative-payment options. Sweeney described fees as potentially ranging from about 10% to 20%, compared with previously reported rates of 15% to 30%, and characterized the result as a meaningful improvement rather than a perfect outcome. These figures are attributed to Sweeney’s account in the reporting; they should not be read as one guaranteed rate for every developer, region or transaction. The available reporting does not establish every term, duration or implementation detail of the agreement. GamesBeat’s interview describes the deal and Sweeney’s assessment.

Nor does permission automatically produce effective competition. August 2026 reporting said a U.S. judge remained dissatisfied with aspects of Google’s efforts to help users find rival app stores, including search and an “Are you looking for?” flow. That is a reminder that a store may be legally permitted yet still struggle to reach users. Android Central reported on the discovery dispute.
Why the Apple and Google outcomes differ

Android’s greater technical openness does not mean Google cannot act as a gatekeeper. Equally, the Google remedies should not be transferred to Apple: the legal findings and platform rules are different. Epic’s Google victory was broader in court, while the Apple case produced a narrower result.

What could change for players and developers?
For players, alternative payment routes or stores could mean more choice and potentially lower prices. They could also mean extra installation steps, another account, unfamiliar refund processes, fragmented subscriptions or less consistent parental controls. A developer may keep some or all of a fee reduction rather than passing it along, so lower platform fees do not prove that consumers will pay less.

For developers, a headline commission is only one part of the calculation. The practical questions include whether outside billing is easy to use, whether a platform takes a separate fee on external transactions, how prominently a link can appear, how many users a rival store can reach, and who handles payment disputes, taxes, fraud and refunds. Supporting multiple stores and billing systems can also add engineering and customer-service work.
Regional rules matter too. A payment or distribution option available in one country may not be available in another, and a policy change on Android does not make the same option available on iPhone or iPad. Players should check the actual price, source, refund terms, account requirements and device compatibility before choosing an outside store or payment route.
How to judge whether the changes are real
The most useful test is not whether a court order or agreement says alternatives are allowed. It is whether a developer can offer them on workable terms and whether users can find and use them without disproportionate friction. Look at:

- Effective cost: What remains after platform charges, payment processing, taxes, refunds and fraud costs?
- Conversion: Do users complete the alternative purchase or abandon installation or checkout?
- Trust and support: Are updates, refunds, subscriptions and parental controls clear and reliable?
- Choice in practice: Can developers reach enough users through an alternative to justify the operational burden?
These criteria explain why the Epic dispute is not only about whether a 30% fee is too high. Distribution, steering, defaults, discoverability and customer relationships determine whether a nominal alternative can compete.
What Sweeney’s campaign has—and has not—achieved
Legally, Epic’s stronger win was against Google, where a jury verdict and injunction survived appeal. Its Apple result was much narrower. Commercially, Epic secured reported concessions from Google but still benefits from access to incumbent stores and has not removed its dependence on them for reach. For consumers, the potential gains are real but not yet synonymous with universal lower prices or frictionless choice.
Sweeney’s criticism remains relevant because formal permission to use another store or payment method is only the first step. Whether competition improves depends on implementation, user adoption and the actual costs and protections offered by each route.
