Fortnite has already returned to Apple’s App Store in many markets; Australia is the major exception identified by Epic Games. In a May 19, 2026 announcement, Epic said the game was back on the App Store “around the world” but not in Australia. Epic says it will return there only if Apple offers lawful payment terms or an Australian court resolves the dispute in a way that lets it do so.
The condition applies to Australia—not every App Store
Epic’s headline-making condition is easy to misread without the geography. It is not a prerequisite for Fortnite to return everywhere: Epic said the game had already returned to App Stores in many markets. The unresolved question in its announcement was whether it could return to the Australian App Store without accepting the payment arrangement it disputes.

Epic describes that arrangement as unlawful and says it is seeking lawful payment terms. Those are Epic’s characterizations, not a universal ruling that Apple’s terms are unlawful in every country. The specific rules and proceedings differ by jurisdiction. Epic’s May 19 statement is the source for its announced availability and position on Australia.

Availability can depend on the storefront associated with an Apple Account, not just where a player happens to be. It can also differ between an App Store listing, an alternative marketplace and a cloud-gaming service. Do not assume that a headline saying “worldwide” guarantees that the game appears in every country’s App Store.

What Epic says Apple must change
Epic’s stated condition is broader than “lower the commission.” It says it will not return to Australia under the disputed payment arrangement and wants Apple to offer lawful terms—or a court to resolve the matter. The announcement does not set out a final fee or complete commercial terms, and it does not establish that Apple has accepted Epic’s position.
That distinction matters because publication and payment are connected but separate questions. A listing could be restored while the companies still disagree over whether Epic can direct players to outside payment options, what Apple may charge on purchases made that way, or which terms apply. A return to the App Store would not, by itself, prove that the payment dispute was settled on Epic’s preferred terms.
How the App Store dispute began
The conflict dates to August 2020. Epic added a way for players to pay Epic directly, bypassing Apple’s in-app purchase system. Apple treated the move as a violation of its App Store rules and removed Fortnite; Epic then sued and publicly challenged Apple’s distribution and payment policies. The Australian Competition and Consumer Commission’s account of the proceedings summarizes the original dispute over commissions and Epic’s alternative payment system.

The U.S. case did not end with a blanket finding that Apple was an illegal monopoly. The original judgment rejected much of Epic’s antitrust case but imposed an injunction restricting Apple’s ability to prevent developers from steering users to other payment methods. Later proceedings focused on whether Apple’s rules complied with that order. That compliance dispute is different from the original antitrust claims, and it should not be reduced to “Epic won its case.”
Why the U.S. return does not settle Australia
The U.S. and Australian disputes are separate legal matters. A U.S. injunction about steering users toward external payments does not automatically dictate the terms of an Australian App Store listing. Epic’s announcement says Australia remained unresolved; it does not establish that an Australian court had ordered Apple to restore the game.
In the United States, a later contempt and compliance fight intensified pressure on Apple. Apple sought a stay while challenging the order; the Supreme Court docket records that the stay was denied on May 6, 2026. Apple later asked the Supreme Court to review the dispute, and on June 30 the Court granted review on a limited question. The docket does not say that the Court ordered Fortnite removed again or automatically suspended the lower-court order. The Supreme Court docket records the review, while the stay docket records the earlier stay decision.

That continuing review leaves uncertainty about the reach and durability of the U.S. payment rules. It does not, on its own, answer whether or when Epic can return to the Australian App Store.

Apple and Epic disagree over payment terms
Epic’s position is that Apple must stop enforcing terms Epic considers unlawful and provide a lawful route for the game to return in Australia. Apple, by contrast, argues that it is entitled to compensation for the technology and services involved in App Store distribution. In its Supreme Court filing, Apple described a proposed commission of 12% to 27% on certain purchases made through external links. That figure is Apple’s argument in a U.S. filing—not a universal fee that applies to every developer, purchase or country. Apple’s filing sets out its position.
Reporting on Apple’s approval of the returning submission described court pressure as part of the context, including a threat to require an Apple official involved in App Store decisions to appear. That is reported context, not a public Apple explanation that resolves the dispute. MacRumors’ account covers that episode.

What could happen next?
- Apple and Epic agree on Australian terms. If they reach terms Epic accepts, it could submit or restore a version for that storefront. The announcement does not say that such an agreement exists.
- An Australian court clarifies or imposes a remedy. Epic says it is pursuing court action, but its May statement is not evidence that a specific order to restore the game has already been issued.
- The U.S. Supreme Court changes the U.S. legal framework. Its review may affect U.S. rules for external payments, but it is not a direct ruling on the separate Australian dispute.
Any “return” could also take different forms: a new build approved for a storefront, a court-ordered listing, or a listing subject to particular payment terms. The central issue for Epic is not simply whether the game can be published; it is whether the terms attached to that publication are acceptable to the company.
How to check whether it is available to you
- Search for Fortnite in the App Store associated with your Apple Account’s country or region.
- If you already have the game installed, check whether it can update; an existing installation does not guarantee that new downloads or updates are available in your storefront.
- If you cannot find it, consider that storefront availability may differ from access through an alternative marketplace or cloud-gaming service. Those are separate routes, with their own regional and device requirements.
- Check for account or device restrictions, including parental controls and device-management settings, before concluding that a regional listing is unavailable.
Changing an Apple Account’s country or region is not a guaranteed workaround and can affect subscriptions, account balances, payment methods and purchases. Check Apple’s current requirements before making that change.
