A browser-based fan game called Fallout: New York appeared online on September 28, 2026, and its creator reported receiving a legal message from ZeniMax Media three days later. By October 2, reports said the project page had been made private. Coverage linked the dispute to Fallout trademarks and the fallout.nyc domain, but the notice has not been independently authenticated and no court ruling is established.
What happened to the browser game?
Insider Gaming reported that Chris First introduced the browser-playable project on September 28, 2026. The coverage described quests, dialogue trees, V.A.T.S. and a working Pip-Boy. First characterized its construction this way: “Zero texture files. Zero sound files. Every building, weapon, face and sound is generated by code.” That is the creator’s description, not an independently verified technical audit. Insider Gaming
On October 1, First reportedly posted that “the suits got involved” and shared an image described as a cease-and-desist message from ZeniMax Media’s lawyers. Insider Gaming said the project page had been privatized by the time its October 2 report appeared. PC Gamer also reported on October 2 that First said he had received a message from ZeniMax. Why was Fallout: New York taken down?
According to the coverage, the alleged notice discussed ZeniMax’s responsibility to enforce its trademarks where unauthorized use could cause consumer confusion or harm its brands. PC Gamer connected the concern to the fallout.nyc domain. Those are reports about what the message asserted, not a legal finding that the game infringed a trademark or confused consumers.

The notice image and the underlying legal message were not independently authenticated for this account. The available reporting establishes that First said he received a message and that the page was no longer public by October 2; it does not establish the full legal basis for the action, any response from ZeniMax beyond the reported notice, or a final resolution. No court decision is established by the sources.
It is not the Fallout: New York mod project
The browser game should not be confused with a separate volunteer effort also called the Fallout: New York Mod Project. That project’s website describes a large-scale New York-area game mod made with the Creation Kit and explicitly says it is not affiliated with Bethesda Game Studios. The takedown reports concern Chris First’s browser game, not that volunteer mod. Fallout: New York Mod Project
