The legal question is separate: emulator software, the source of game files, and any circumvention of copy protection can raise different issues. This article focuses on U.S. law; the answer may differ elsewhere.
Is Switch emulation on Steam Deck legal?
There is no single answer that makes every emulator, game file, and method of access lawful or unlawful. An emulator is software that runs programs designed for one system on another. The legal questions can also involve copyright in the game and whether a person bypasses a technological protection to access it.
The emulator and the game files are separate questions
Nintendo of America Support’s Intellectual Property & Piracy FAQ states: “The uploading and downloading of pirate copies of Nintendo games is illegal.” That is Nintendo’s stated policy and enforcement position. It is not a complete neutral ruling on every kind of emulation or personal copy.
So, do not treat the fact that a program is an emulator as proof that every use of it is lawful—or treat the existence of an emulator as proof that all emulation is illegal. The origin and use of game files matter independently.

Copy-protection circumvention has its own rules
The U.S. Copyright Office explains that Section 1201 of the Digital Millennium Copyright Act generally prohibits circumventing technological measures that control access to copyrighted works, including video games and computer software. It also describes a triennial process through which the Librarian of Congress may adopt limited, temporary exemptions for specific classes of noninfringing uses.
That general rule does not resolve whether a particular emulator or action involves circumvention, or whether a specific exemption applies. It is not a blanket determination that every personal backup is permitted or prohibited.

What the Yuzu case did—and did not—decide
On March 4, 2024, the U.S. district court entered a final judgment and injunction against Tropic Haze LLC, the defendant associated with the Yuzu emulator. The injunction restricted the defendant and specified associated parties from trafficking in Yuzu and covered circumvention software and materials, including unauthorized cryptographic keys and materials covered by the judgment.
That was a case-specific judgment and injunction. It did not establish that every emulator, or every individual act of emulation, is unlawful.

Do you need a Switch console?
No. Valve describes Steam Deck as a handheld gaming computer running SteamOS; owning a Switch is not a prerequisite for using the Deck. That hardware description does not establish whether a particular Switch emulator is available, works well, or is lawful.
A Switch is an optional route if you want Nintendo’s official hardware, games, platform features, and services. Buying one does not, by itself, settle whether copying or decrypting game files is lawful.

Which route fits what you want to do?

These routes are not interchangeable legal conclusions. The Steam Deck’s hardware category says what kind of device it is; it does not answer the copyright or circumvention questions for a particular setup.
Why the answer can change by country
The legal explanation above is U.S.-focused and is general information, not advice about an individual’s conduct. Nintendo’s support FAQ states Nintendo’s position, while the Copyright Office explains the U.S. Section 1201 framework. Neither alone settles how another country treats emulator software, personal backups, or circumvention.
