Owning the original cartridge or disc does not, by itself, authorize downloading a copy from a third-party site. U.S. law does allow a narrow archival-copy exception for certain legal owners of computer-program copies, but it is not a general right to obtain a ROM online. Emulator software, game files, firmware, and circumvention of access controls are separate questions. This is general information, not individualized legal advice; laws differ by country.
Is it illegal to download ROMs?
A ROM is a digital copy of game software. Making a copy can implicate the copyright owner’s reproduction rights; uploading or distributing it can implicate distribution rights. The U.S. Copyright Office says that downloading or uploading copyrighted works without the copyright owner’s authority through peer-to-peer networks infringes the owner’s exclusive rights of reproduction and/or distribution. It also advises that most works should be presumed protected unless there is clear information to the contrary.
That principle makes the source of the file important. A game offered by its rights holder through an authorized store is different from a copy posted by an unknown third party. A file’s availability online, a site’s claim that a game is “abandonware,” or the fact that a game is old does not establish permission to copy it.
What could infringement cost?
The Copyright Office’s current FAQ, observed in 2026, describes potential U.S. statutory damages of up to $30,000 per infringed work, or up to $150,000 per work if willful infringement is proven, as well as possible attorney’s fees. These are statutory maxima, not automatic fines or predictions of what a particular person would owe.

Why sharing and hosting carry distinct risks
Downloading, uploading, and operating a site that makes game files available are different conduct. WIPO’s enforcement paper describes ROM creation as wholesale duplication and discusses distribution-related claims against uploaders and hosting operations. It reports that the 2021 Storman decision found direct, contributory, and vicarious infringement tied to uploading and making Nintendo ROM files available. That example concerns distribution operations; it does not establish that every individual downloader has been adjudicated in the same way.
Is downloading a ROM legal if I own the game?
Ownership of a physical cartridge or disc does not automatically authorize a separate copy supplied by someone else. The U.S. Copyright Office describes a limited archival-copy rule for a legal owner of a computer-program copy. In the Office’s words: “Under section 117, you or someone you authorize may make a copy of an original computer program if the new copy is being made for archival (i.e., backup) purposes only; you are the legal owner of the copy; and any copy made for archival purposes is either destroyed, or transferred with the original copy, once the original copy is sold, given away, or otherwise transferred.”
The rule is about an owner-made archival copy under those conditions. It does not say that owning a game entitles you to download a third party’s ROM, nor does it establish that every method of extracting a console game is lawful. The Office advises checking the software’s sale terms or license agreement, which may affect the ability or right to make a backup.

Can I make a backup of my game cartridge?
Section 117, as summarized by the Copyright Office, is the relevant U.S. archival-copy provision for computer programs. Its stated conditions concern who makes the copy, why it is made, ownership of the original copy, and what happens to the backup if the original is transferred. Whether a particular game and copying method fit those conditions depends on the facts and applicable license terms.

There is also a separate access-control issue. Copying a game may involve bypassing technological measures that control access. A possible archival-copy argument does not, by itself, resolve whether circumvention is permitted under the DMCA.
How does the DMCA apply to games and ROMs?
Section 1201 of the DMCA generally restricts circumventing technological measures used to prevent unauthorized access to copyrighted works, including video games and computer programs. Congress provides a rulemaking process for limited, temporary exemptions. The U.S. Copyright Office’s ninth triennial proceeding resulted in a final rule dated October 28, 2024.

Those exemptions are narrow: they depend on the user, purpose, game, service status, and other conditions. They do not create a general consumer right to download or share ROMs.
Local play after an authentication server shuts down
A current exemption covers specified copying or modification to restore local gameplay for certain lawfully acquired, complete games that require an external authentication server, when the copyright owner or its representative has ceased providing access. The regulation defines “ceased to provide access” as an affirmative statement that support has ended and is unavailable, or support being discontinued for at least six months without restoration. The exemption concerns the specified restoration activity; it is not blanket permission to obtain any unavailable game from a ROM site.

Separate provisions allow eligible libraries, archives, and museums to undertake specified preservation activities for certain games. The rules include conditions such as lawfully acquired collections, a public-service mission, trained staff or volunteers, reasonable digital security, and no direct or indirect commercial advantage. For the relevant preservation provisions, distribution outside the institution’s physical premises is restricted. Certain provisions also concern complete games no longer reasonably available commercially, with conditions that vary by provision.

Can libraries preserve old games?
Yes, under specific U.S. exemptions and conditions—not as a general exception for everyone who wants to download or circulate old games. The applicable provision depends on the game’s status, whether it requires an external authentication server, the institution’s eligibility, and the preservation activity. The regulation’s conditions should be checked directly before relying on an exemption.
“Abandonware” is not a blanket legal category that makes a game free to copy. A game being unavailable for sale, unsupported, or difficult to access does not alone establish authorization for public distribution.

An emulator and the game files used with it should be analyzed separately. The legal status of the ROM depends in part on how it was made or obtained and whether copying or sharing was authorized. Firmware or system software may raise additional questions, and bypassing an access control can raise DMCA issues.

The sources summarized here do not establish a comprehensive rule for every emulator implementation, firmware source, or use. It would be too broad to say that every emulator is legal or illegal. The relevant facts and the law in the user’s jurisdiction matter.
What changes outside the United States?
Copyright and anti-circumvention rules vary by country. WIPO’s enforcement paper offers comparative context and explains that ROM duplication will in most jurisdictions implicate copyright absent authorization, but it is not a country-by-country legal guide. For a country-specific answer, consult that jurisdiction’s law or a qualified local adviser.
Nintendo UK’s online piracy guidance says authentic Nintendo games can be purchased for download online through Nintendo eShop or Nintendo’s website only, and characterizes downloading and uploading pirate copies as illegal. That is Nintendo UK’s guidance for its UK/Ireland context; it is not a statement of U.S. law or a universal rule for every publisher.
How to assess a particular ROM situation
There is no single “I own it” or “it is old” test that settles every case. The useful questions are:
- Source: Did the rights holder authorize the store or distribution channel, or is the file from a third-party ROM site or peer-to-peer network?
- Conduct: Are you making a private archival copy, downloading, uploading, hosting, or bypassing an access control? These are not interchangeable acts.
- User and purpose: Is this individual local play, or an activity by a qualifying library, archive, or museum under a specific preservation provision?
- Game and service status: Does a relevant exemption require an external authentication server that has ceased support, or a game that is no longer reasonably commercially available?
- License and territory: What do the game’s license terms say, and which country’s copyright and anti-circumvention laws apply?
The U.S. Copyright Office’s posted Title 17 compilation includes enacted amendments through December 18, 2025. For a consequential decision, consult the applicable statutory text, current regulations, the game license, and a lawyer familiar with the relevant jurisdiction.
