Not without the rights needed for the specific bhajan, version, recording, territories, and uses. Devotional subject matter does not make a song or recording copyright-free. YouTube scans live streams for third-party content and may interrupt or terminate a stream if copyrighted material continues after a warning. Even if you have permission, YouTube says the rights holder may need to add your channel to its Content ID allowlist to prevent interruptions.
What “copyrighted bhajan” can mean
A bhajan is devotional music, but that label alone says nothing about whether a particular version is free to stream. One song can involve several separate rights: the underlying musical composition, lyrics, a particular arrangement or performance, and the released sound recording. Different people or organizations may control those rights.
India’s government copyright materials distinguish musical works, literary works such as song lyrics, and sound recordings. A traditional composition may therefore be out of copyright while a newer arrangement, set of lyrics, performance, or recording remains protected. The status also depends on authorship, publication, applicable copyright terms, agreements, territory, and the exact material used.
What YouTube can do to a live stream
YouTube says all live streams are scanned for matches to third-party content. If it identifies copyrighted material, it may replace the stream with a placeholder and warn the streamer to stop using the material. If the material continues, YouTube may temporarily interrupt or terminate the stream. Copyright strikes can also affect access to live streaming.

A permission letter and YouTube’s Content ID handling are separate practical issues. YouTube advises creators who have licensed third-party content to ask the owner to allowlist their channel. Without that step, a licensed stream may still be interrupted, including where a rights holder’s territorial restrictions appear to match the creator’s permissions.
The recording after the broadcast is another exposure point. YouTube says archived live streams can receive Content ID claims after the live broadcast ends. A claim may result in a video being monetized, tracked, or blocked, sometimes only in particular territories. A Content ID claim is distinct from a copyright takedown and strike.

Clear the exact material before going live
- Make a track-by-track inventory. Identify each bhajan and the exact version or recording you plan to play. Note the lyricist, composer, arranger, performers, label or producer, and recording owner where you can establish them.
- Identify every right involved. Check the lyrics, composition, arrangement, performance, and sound recording separately. Do not assume that a traditional melody clears a modern recording or that permission for one element clears the others.
- Get written authorization from the relevant rights holders. Confirm that it covers YouTube live transmission, repeated or continuous use, the countries where the stream will be available, monetization, duration, looping or edits, and the live-stream archive or replay. Buying or downloading a music copy does not by itself grant public-performance or streaming rights.
- Check any licensing society’s mandate and repertoire. For India, IPRS describes licensing for musical works and associated lyrics, including communication and making available. Confirm that the specific works are in its repertoire and that a license covers this particular YouTube use. Do not infer that a society license also clears a separate sound recording or rights outside that society’s mandate.
- Arrange Content ID allowlisting before the stream. Ask the owner or its administrator to add your channel to the relevant allowlist, then retain the written license and confirmation. Keep a contact for resolving a mistaken match or claim.
- Plan for the archive as well as the live broadcast. Confirm whether the permission covers leaving the recording available afterward and what to do if a claim appears. A live stream that finishes without interruption is not proof that the archive is cleared.
For any music source or license, compare the rights covered, territories, live versus archived use, continuous or looping use and duration, monetization, Content ID treatment, and proof of authorization. YouTube’s livestream terms place responsibility on the provider to have the necessary rights for exploitation of live content on Google services worldwide, including music licensing rights.
Does India’s religious-ceremony exception cover an always-on stream?
Section 52(1)(za) of India’s Copyright Act, 1957 provides an exception for performance or communication to the public of a literary, dramatic, or musical work, or a sound recording, in the course of a bona fide religious ceremony. The statutory text says a religious ceremony includes a marriage procession and associated social festivities.

That wording is tied to use “in the course of” a bona fide ceremony. It does not expressly settle whether an always-on, public, or monetized YouTube channel qualifies, and it should not be treated as a general exemption for devotional programming. If you plan to rely on this exception, get legal advice on the specific facts rather than assuming that bhajans streamed around the clock are covered.
The Indian statutory exception does not determine the law in every country where viewers can access a stream. YouTube’s terms frame the rights warranty worldwide, while rights, exceptions, licensing mandates, and territorial scope may differ. For an international audience, check the planned territories rather than treating Indian permission or an Indian exception as global clearance.

Safer music options and common assumptions to avoid
- YouTube Audio Library: YouTube recommends it as a source of copyright-safe music. Read the terms for each track and confirm they fit the planned live and archived use.
- Third-party music: Check the actual license for where and how the music may be used, including livestreaming, repeated playback, and archives. Do not assume a license for ordinary videos automatically covers a 24/7 live stream.
- Creator Music: Do not assume it clears live-stream use. YouTube’s cited revenue-sharing track terms say videos using those tracks cannot be live streams; verify the current terms for the specific track and use.
- A purchased or downloaded recording: Possession of a copy is not the same as permission to communicate it to the public or stream it continuously.
- Religious or noncommercial intent: Neither devotional purpose nor the absence of a charge, by itself, establishes that the required rights have been cleared.
