Short answer: An Indian radio station should not assume its terrestrial broadcast licence or statutory licensing route automatically covers a YouTube livestream. YouTube expects the channel to hold the necessary rights for music streamed on its platform, and it may interrupt a stream even when the station has a licence if the relevant rights owner has not allowlisted the channel. Clear the composition and the sound recording for the YouTube stream and any replay, confirm territory and repertoire, and get India-specific legal advice on whether section 31D applies to the proposed simulcast.
Does a radio licence cover a YouTube livestream?
Do not treat a terrestrial broadcast permission as automatic clearance for an online simulcast. YouTube’s livestream terms require the provider to represent that it has the necessary rights to exploit live content on Google services worldwide, including music rights. That is a platform requirement; it does not decide who controls a particular Indian song or settle how Indian licensing law applies to YouTube.
Indian law defines broadcasting and communication to the public broadly, and section 31D provides a statutory-licence framework for broadcasting certain published works and recordings. But the legal material cited here does not establish whether a radio station can rely on section 31D for a YouTube livestream. Do not assume the answer is definitely yes or definitely no: confirm the position with Indian copyright counsel and the relevant rights holders before going live. See the Government of India’s Copyright Act, 1957, Chapter I, Chapter III, Chapter VI, and Copyright Rules, 2013, Chapter VIII.
A 2024 music-industry submission to TRAI argues that the statutory regime is limited to radio and television broadcasting. Which music rights must the station clear?
For each track, distinguish the underlying musical work—including composition and lyrics—from the particular sound recording. Different owners or administrators may control those rights. The Copyright Office’s Hand Book of Copyright Law explains that using a sound recording may involve licences for both the public performance of the music and the recording, where the relevant societies represent those works.
- Musical work and lyrics: Identify the relevant authors, publishers, or society and verify that the permission covers the track and the rights needed for a YouTube livestream.
- Sound recording: Identify the owner or administrator of the specific recording and confirm its authority and permission for the same use.
- Repertoire and authority: Do not assume a society controls every song, recording, or right. IPRS describes licensing for its repertoire and author members; PPL India describes licensing for sound recordings in its repertoire. Confirm control and scope track by track. For each permission, ask whether it covers the platform, territories, type of use, and any archived or on-demand copy. Permissions for one layer or use should not be treated as proof that the other layer or use is cleared.

What can happen to music during or after the stream?
YouTube scans live streams for third-party content. If it detects material, the stream may show a placeholder and warning; if the content remains, YouTube may interrupt or terminate the broadcast. YouTube also warns that a licensed stream can still be interrupted if the channel has not been added to the relevant rights owner’s Content ID allowlist. After the stream ends, Content ID claims may be made against an archived livestream. Read YouTube’s guidance on copyright issues with live streams and its page on using Content ID matching on live streams.
A licence and an allowlist solve different problems: the licence is permission for the use; the allowlist helps prevent the rights owner’s Content ID system from interrupting the channel. Neither should be assumed from the other.

Pre-live clearance checklist for an Indian radio station
- Make a track list. Record each composition and recording that will be broadcast, including any jingles, transitions, or background music, and identify the relevant rightsholders or administrators.
- Get written permission for the actual use. Ask specifically about a YouTube livestream or simulcast, not just terrestrial broadcast or general public performance. Confirm the relevant musical-work and sound-recording rights.
- Confirm territory and duration. Check where viewers may access the stream and whether the permission covers those territories and the period the stream is available.
- Settle the replay question. If the broadcast will remain available as an archive or on-demand video, obtain permission for that use too. If it is not cleared, disable or remove the archive as appropriate.
- Request channel allowlisting. Ask the rights owner to allowlist the exact YouTube channel, and obtain confirmation before the broadcast. Keep the confirmation with the permissions.
- Check reporting, notice, and royalty terms. If relying on any licence route, follow its applicable reporting and payment requirements. Section 31D and Rule 29 contain notice and royalty provisions; whether that route covers a YouTube simulcast is a legal question requiring current advice.
- Keep a clearance file. Retain the agreements, track and repertoire information, territory and archive terms, notices and payment records, plus allowlist confirmation. This makes it easier to answer a rights query or investigate a claim.
Do free music labels, Content ID, or Creator Music clear the broadcast?
No platform detection tool substitutes for permission. YouTube cautions that music described as “free” can still be flagged by Content ID. Its current Creator Music guidance describes tracks in that catalog as available for long-form videos, not livestreams. Do not use either label or tool as evidence that a radio simulcast is cleared. If YouTube interrupts a licensed stream
- Stop or replace the identified material. Follow the warning and do not assume the licence alone will prevent another interruption.
- Check the exact channel’s allowlist status. Contact the rights owner or administrator to verify that the channel is included and that the relevant recording and composition are covered.
- Recheck the scope of the permission. Confirm YouTube, the relevant territory, the live use, and any archive are included. A terrestrial-only or different-use permission may not answer the platform’s question.
- Preserve notices and records. Keep the platform notice, track list, permission and allowlist correspondence together. Seek legal advice if the parties disagree about the licence or section 31D.
