Can a YouTube Live Stream Use Public-Domain Music Without Attribution?

Generally, yes—if both the musical composition and the exact recording you play are genuinely public domain in the relevant territory. Public-domain music does not ordinarily require attribution as a copyright condition. But an old composition can have a newly recorded, still-protected performance, and YouTube may scan a live stream for third-party matches even when you believe you have cleared the music.

Check the composition and the recording separately

A musical composition is the music and any lyrics; a sound recording fixes a particular performance and production. The U.S. Copyright Office treats them as separate works: copyright in a recording is not the same as, or a substitute for, copyright in the underlying composition. See the U.S. Copyright Office guidance on musical compositions and sound recordings.

That distinction matters if you want to play classical music on a YouTube livestream. A composer’s old symphony may be public domain, while a modern orchestra’s recording of it remains protected. Check the rights status or license for the exact recording—not just the age of the tune or composer.

Public-domain status depends on the work and territory

There is no single worldwide cutoff date. For U.S. works, the Copyright Office says works published before January 1, 1931 are in the public domain because their copyright has expired. That is a U.S. reference point, not a universal rule or a complete test for every recording. Copyright status can depend on territory, publication and creation dates, authorship, and the particular source recording.

Recordings need particular care: the Copyright Office notes that pre-February 15, 1972 sound recordings may remain protected under state law until February 15, 2067. A very old composition therefore does not, by itself, establish that a recording is free to use.

Attribution is different from permission

If both the composition and recording are verified as public domain, attribution is not ordinarily required as a copyright-license condition. Giving credit does not make an otherwise uncleared recording lawful to use.

A licensed track has its own terms. For example, YouTube says users of works under a Creative Commons Attribution (CC BY) license need to credit the creator. Follow the particular license rather than assuming that a credit line is enough. Check whether its terms cover live streaming, archived replays, monetization, and the territories where your stream will be available. YouTube’s Creative Commons guidance explains the attribution condition.

What can happen when YouTube detects music in a live stream

YouTube says all live streams are scanned for matches to third-party content, including copyrighted content in another live broadcast. If it identifies third-party content, YouTube may replace the stream with a placeholder and warn the streamer. Continuing to transmit the identified content can result in a temporary interruption or termination.

Archived streams are a separate stage: if you choose to archive a live stream, YouTube says Content ID claims are made after the stream ends. A claim is not, by itself, proof that your public-domain assessment is wrong. YouTube says its Content ID system does not consider a written description calling music “free.” Depending on the rights holder’s settings and geography, a claim can affect visibility or earnings; a Content ID claim is not the same as a copyright takedown or strike. Verify a track before you go live

  1. Identify the exact file. Save the track title, performer, recording details, and the page or collection from which you obtained it.
  2. Check both rights layers. Confirm the composition’s status and the exact recording’s status or license. Do not infer the recording’s status from the composition’s age.
  3. Check territory and intended uses. Confirm that the rights basis covers the places where viewers may watch, live streaming, and any archived replay. If you plan to monetize, check that too.
  4. Follow any license conditions. If the track is licensed rather than public domain, check attribution and other conditions for that specific license. A “free” label or credit alone does not establish permission.
  5. Keep your evidence together. Retain the source page, rights statement or license, and recording identity so you can explain why you believe the particular file is cleared.
  6. Plan for platform matching. A rights holder who has licensed third-party content for your stream may need to add your channel to their Content ID allowlist to avoid interruption. Confirm this with the rights holder where applicable.

What to use if you cannot verify the rights

If you cannot establish that both layers are public domain or confirm that a license covers your intended use, choose music from YouTube’s Audio Library, which YouTube recommends for copyright-safe music and sound effects. For tracks from another service or website, read the specific license rather than relying on a general “free music” label.
