If a giveaway winner has not responded, go back to the rules you published before the drawing. Follow the stated claim deadline and contact method, keep a dated record of your attempts, and take only the next step those rules and applicable law allow. There is no universal waiting period for private stream giveaways.
What happens if a giveaway winner doesn’t claim the prize?
The outcome depends on the terms announced for that promotion and the law that applies to it. If your rules say an alternate winner may be selected after a particular claim deadline, follow that procedure. If the rules are silent or unclear, do not assume that you may keep the prize, draw again, or give it to someone else. Pause and get advice specific to the promotion before deciding.
Do not borrow a deadline from a government lottery and treat it as a rule for a creator giveaway. For example, North Carolina’s statute addresses prizes in its state lottery: it says prizes unclaimed after the applicable period are not abandoned property and are handled under that chapter. That lottery-specific rule does not establish what happens to a private stream giveaway prize. North Carolina General Statutes § 18C-132.
How long should you wait for a giveaway winner to respond?
Use the claim period stated in the original rules; the available sources do not establish a default number of hours or days for private stream giveaways. Check the original announcement and terms for the deadline, the required response method, any eligibility conditions, and what happens if a valid claim does not arrive. Do not shorten or extend the deadline arbitrarily.

If the original terms did not set a deadline or explain the next step, the result may depend on your jurisdiction, platform, prize, and entry method. Preserve the original announcement and get jurisdiction-specific advice before disposing of the prize or choosing another winner.
Follow a consistent process
- Find the terms that were in effect when entries opened. Identify the organizer, prize, eligibility requirements, claim route and deadline, information reasonably needed to deliver the prize, and any alternate-winner or unclaimed-prize provision.
- Check that the winner notice used the promised route. Send it through the channel or account identified in the rules. If a reminder is allowed by the terms or your established procedure, send one without changing the deadline arbitrarily.
- Keep a dated record. Save the announcement and rules as published, the drawing or selection record, timestamps and copies of notices, any replies, and the date the stated claim period ends. This is prudent administration, not a recordkeeping period set by the sources cited here.
- Protect the winner’s privacy. Do not expose personal details or private messages while trying to make contact.
- Apply the disclosed next step when the deadline passes. If the terms authorize an alternate winner, follow that process consistently. If they provide no next step, pause rather than improvising an outcome; seek advice that accounts for the organizer’s jurisdiction, platform, prize, and promotion terms.
- Deliver a claimed prize safely. Ask only for information needed to arrange delivery. Do not charge a claim, processing, or shipping fee, or ask for bank or credit-card details to send a prize.
- Close the loop if useful. A short factual public update can clarify that the prize was claimed or that the process is continuing. Do not share private correspondence or say that someone forfeited unless the published terms and applicable requirements support that statement.
Keep prize claims free and protect personal information
The Federal Trade Commission’s consumer guidance says, “If you have to pay to get your prize, it’s a scam.” Do not make payment a condition of claiming a prize, and do not request financial details or unnecessary sensitive information to deliver it. The FTC’s guidance also explains that real sweepstakes are free and by chance; it is useful for safe prize communications, but it does not set a waiting period for livestream giveaways. Federal law includes requirements for certain sweepstakes conducted by mail, such as stating terms and conditions and not representing a person as a winner unless that person has won. Those requirements should not be treated as a universal rule for every private stream promotion. The relevant statutory material is available through the U.S. Code, Title 39, Part 4; consult a qualified adviser about how the law applies to your specific promotion.
When the original giveaway rules are unclear
Do not fill gaps in the rules with assumptions. The outcome may turn on where the organizer is located, which platform hosted the promotion, what the prize is worth and how entries were collected. Preserve the original wording and records, then get advice for those circumstances before keeping the item, selecting another winner, or running the giveaway again.

Platform terms are a separate check from giveaway rules and local law. Review the current policy for the platform where you ran the promotion rather than assuming another platform’s requirements apply.
