Usually, not without permission. Being able to listen to a podcast episode on Spotify does not establish that you have the rights to rebroadcast it on YouTube Live. Before streaming someone else’s episode, get permission from the relevant rights holder or holders for the planned use—including any music or other third-party material in the recording. Even with permission, YouTube may interrupt a live stream unless the rights holder adds your channel to its Content ID allowlist.
Why Spotify access does not answer the rights question
Listening to an episode through Spotify and rebroadcasting it to a YouTube audience are different uses. YouTube’s livestream terms and conditions put responsibility on the streamer to have the rights necessary to exploit the live content, including applicable music rights. Spotify playback access alone is not evidence that those rights cover a YouTube live stream.
The rights chain can vary by episode and territory. The recording may involve rights in the spoken program as well as music or other third-party material embedded in it. Permission for one element should not be assumed to clear the rest. The terms applicable to a particular Spotify episode cannot be determined from its availability on the platform; check with the relevant rights holder or holders.
What permission should cover
Ask for written permission that matches what you actually plan to do. Before going live, confirm that it covers:

- The recording and its contents: the episode itself, plus music and other third-party material included in it.
- The platform and format: rebroadcasting the material in a YouTube live stream.
- The audience and territory: where the stream may be viewed, and any geographic limits.
- The term and monetization: how long you may use it and whether monetized streaming is permitted.
- An archived replay: whether the permission also covers leaving the stream recording available after the live broadcast.
- Attribution conditions and Content ID: any required credit, and whether the rights holder must allowlist your channel.
YouTube’s copyright guidance explains that creators need to consider the rights needed to use content on YouTube. A vague approval may not cover every part of an episode or every planned use, so clarify the scope rather than assuming.
How YouTube can respond to a live stream
YouTube scans live streams for third-party content. Its live-stream copyright guidance says a stream may show a placeholder, display a warning, or be interrupted or terminated. Copyright or Community Guidelines strikes can also result in termination.

Permission does not necessarily prevent an automated interruption. YouTube advises creators who have licensed third-party content to ask the owner to add their channel to the Content ID allowlist. As YouTube puts it: “If your channel isn’t added to their allowlist, your live stream can be interrupted even if you’ve licensed the third-party content.” Ask about allowlisting before the broadcast, not after a stream is disrupted.
Credit, disclaimers and short clips are not permission
Attribution may be required by a license, but credit by itself does not grant rights. YouTube states: “Giving credit to the copyright owner does not automatically give you the rights to use their copyrighted content.” A disclaimer such as “I do not own this” does not change that. Nor does using only a few seconds automatically make the use lawful; YouTube notes that even short uses can raise copyright issues. See YouTube’s common copyright myths.

Could a copyright exception cover an excerpt?
Possibly, depending on the facts and the law that applies where the use is assessed, but this is not a reliable shortcut for rebroadcasting an episode. In the United States, fair use is a case-specific legal analysis involving factors such as the purpose and character of the use, the nature of the work, the amount used, and the effect on the work’s market. YouTube emphasizes that courts decide individual fair-use cases; its platform guidance is not a legal ruling. Other countries may have different exceptions and rules. Read YouTube’s fair-use overview and seek advice for the relevant jurisdiction if you plan to rely on an exception.
Using a short excerpt in commentary or criticism may present a different legal question from playing an episode for an audience, but neither the length of the clip nor the label you give the stream guarantees an exception. Consider the actual purpose, context, amount used and local law.

Creator Music does not clear a live podcast rebroadcast
YouTube Creator Music is not a general clearance route for this use. Its current guidance says licensing is not supported for live content. Check the current Creator Music FAQ and usage details for the scope of that product; do not treat a Creator Music license as permission to play a podcast episode live.
A practical decision path before you go live
- Identify the exact episode. Note the recording and check its credits or other available information for music and third-party content. Do not assume the podcast publisher controls every included element.
- Identify the relevant rights holders. Ask who can authorize the recording and each material embedded element for the use you intend.
- Request permission for the actual broadcast. Specify YouTube Live, territory, duration, monetization and whether the replay will remain available. Keep a record of the permission and its conditions.
- Confirm Content ID handling. Ask whether the owner needs to add your channel to an allowlist so a licensed stream is less likely to be interrupted by automated matching.
- If relying on an exception, assess the specific facts and local law. Do not treat credit, a disclaimer or a short excerpt as automatic clearance; get qualified legal advice where appropriate.
- If you cannot verify the rights, choose different content. Use material whose license clearly permits the planned live use, and check any attribution, territory, archive and allowlisting conditions attached to that license.
