Not automatically. Banjo-Tooie: Recompiled is a public fan project whose repository says it distributes code, not Banjo-Tooie’s game assets, and requires users to supply a USA ROM. That distinction does not make every ROM source lawful, certify every download, or prove a third-party executable is safe. Nintendo says downloading unauthorized copies of its games is illegal; the project’s reported gameplay tests are not an independent security audit.
What Banjo-Tooie: Recompiled is—and what it distributes
The project repository describes Banjo-Tooie: Recompiled as a native PC port made by statically recompiling the original Nintendo 64 ROM with N64Recomp and rendering through RT64. The project says its repository contains code, “does not contain game assets, and never will,” and requires the user to provide a USA game ROM at runtime. It also says the ROM is neither downloaded nor bundled.
Those are the project’s own statements about its code and intended setup. They do not verify the contents of a repack hosted elsewhere, or establish that a particular executable was built from the documented source.
The README identifies the project’s code as GPL-3.0 and lists licenses for several dependencies. It also flags a font marked “All rights reserved” and says it should be replaced before redistributing the project. These licensing notes describe the project’s stated terms; they are not a legal ruling on every component or use.

Is downloading it legal?
There is no universal yes-or-no legal conclusion established here. Separate the project code from the game ROM and from the exact file you intend to download. Laws and the details of a person’s circumstances vary by jurisdiction.
- The project code: The repository presents the project as code that does not include game assets. That account does not itself settle the legality of the project in every jurisdiction.
- The ROM: Nintendo of America’s Intellectual Property & Piracy FAQ says game downloads from peer-to-peer networks or third-party-hosted file links are unauthorized copies and states: “The uploading and downloading of pirate copies of Nintendo games is illegal.” This is Nintendo’s stated position on unauthorized game copies; it should not be mistaken for a court ruling about every independently made port or every user’s circumstances.
- The executable: A binary’s source and contents are separate questions from the ROM’s status. A file that bundles a game ROM is not the same download as a code-only project, regardless of how its uploader describes it.
Nintendo of Europe’s emulator guidance warns that unauthorized emulators can encourage use of pirate copies and says some circumvent security measures and are unlawful. The Banjo-Tooie project describes its method as static recompilation with no emulator at runtime. Nintendo’s general emulator page does not specifically classify or adjudicate this project.

Is a download safe?
Safety depends on the exact file and where it came from. The project’s repository and documentation can help identify its stated source and contents, but the reviewed project information does not provide an independent malware scan, security audit, reproducible-build verification, or hash comparison for a named release binary. The project’s functionality checks do not show that an executable is malware-free, and GitHub hosting alone is not a safety guarantee.
The repository page reviewed lists no entries under Releases. That means the available evidence does not establish an official prebuilt binary there; it does not prove that no project build exists elsewhere. Treat an executable on an unrelated mirror as a separate file whose authenticity and contents have not been established by the repository’s statements.

Checks before downloading
- Start from the maintainers’ current repository and check that the project identity and any download link match it.
- Do not download a copy advertised as including Banjo-Tooie or a game ROM. Nintendo says third-party-hosted Nintendo game downloads are unauthorized copies and calls downloading pirate copies illegal.
- Do not treat developer gameplay testing, a repository page, or a mirror’s claims as an independent security certification of the executable.
What testing has the project reported?
The README reports that the game is playable end to end and that Windows x64 checks covered booting, gameplay, repeated scene transitions, audio, controller input, overlay loading, and saving and loading. It describes the Linux x64 build as newer and less exercised, and says it has not been played through. These are developer-reported functionality checks, not independent malware analysis or a guarantee about a binary from a mirror.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. Why has this project drawn attention?
In an October 2, 2026 report, GamesRadar+ reported that the creator said AI tools generated substantial portions of the code and assisted with engineering and review. The report also quoted Dario, a developer associated with the original N64: Recompiled project, saying, “The Banjo-Tooie Recompilation is NOT associated with us.” This is relevant to authorship and project identity, not evidence of malware or a legal determination.
