In the United States, a ship’s hull and deck design are not protected by copyright as such, but that does not make every depiction of a ship free to copy. A drawing, 3D model, texture, ornamental decoration, or logo can raise separate rights questions, and qualifying vessel designs may have a distinct form of protection under Chapter 13 of Title 17. Fair use is a case-specific, four-factor analysis—not a blanket permission for games, realism, or small amounts of copying.
This article covers U.S. federal law. Other countries may apply different rules, and no general explanation can determine the status of a particular game asset.
First identify what “ship design” means
A game asset can combine several different kinds of material. Treating all of them as one “ship design” obscures which legal questions matter.

The Compendium also says Chapter 13 does not itself provide, extend, or limit copyright protection for drawings, models, or statuaries of vessels. In other words, a rule about the underlying hull or deck does not settle the rights in a separately created image or model.

What Chapter 13 protects—and what it does not establish
Title 17, Chapter 13 establishes a vessel-design protection regime separate from ordinary copyright. It addresses an original design of a useful article that makes the article attractive or distinctive to the purchasing or using public, subject to the chapter’s requirements. For originality, the design must be a distinguishable variation over prior work pertaining to similar articles, more than merely trivial, and not copied from another source. The statutory text is available in the U.S. Copyright Office’s Chapter 13 materials; the Title 17 publication cited there includes amendments through December 18, 2025.
The statutory definition is narrower than “anything shaped like a ship”
Under 17 U.S.C. § 1301(b)(3), a “vessel” is a craft “that is designed and capable of independently steering a course on or through water through its own means of propulsion” and “that is designed and capable of carrying and transporting one or more passengers.” The statute’s definitions of hull and deck exclude specified components, including the deck itself from the hull definition and listed items such as superstructure, masts, sails, rigging, hardware, fixtures, and other attachments.

Those boundaries make it unsafe to assume Chapter 13 covers every ship-like object. A fictional spacecraft, a digital design detached from a qualifying vessel, or a depiction of an actual vessel does not automatically meet the statute’s definitions. The cited official materials do not resolve every question about purely virtual depictions.
Do not call it “copyright in all ship designs”
The Copyright Office distinguishes Chapter 13’s vessel-design protection from copyright in artistic works. Its Compendium guidance surfaced as 2021 guidance and describes the overall shape and form of a watercraft’s hull or deck as a useful article that cannot be protected by copyright as such. That statement is not a ruling that every associated drawing, model, decoration, or logo is unprotected.

Apply copyright analysis to the material actually used
Before asking whether a game’s use is fair, identify its source. A developer might be using historical facts, a physical ship as reference, a particular photograph or plan, a licensed model, or an expressive design from another game. The asset may combine several of these. The useful-article status of a hull or deck does not make a specific drawing, photograph, model, or texture available to copy.
Likewise, realism alone does not answer the copyright question. Nor do the available official sources establish that a ship silhouette is automatically protected or that an exact 3D recreation is safe because a vessel is functional. The relevant comparison is between the source material and what the game actually reproduces.

Fair use depends on all four statutory factors
The U.S. Copyright Office’s fair-use overview describes the four factors below. They are considered together; no single factor guarantees the outcome.
- Purpose and character: What is the use for, and is it commercial or nonprofit and educational? A use that adds something new with a further purpose or different character, without substituting for the original use, may be more likely to be considered fair. That consideration is not a standalone test.
- Nature of the original: What kind of copyrighted work is involved? Consider whether the source is, for example, a drawing, photograph, model, or other artwork, rather than treating the physical ship and its depiction as interchangeable.
- Amount and substantiality: How much was used in relation to the source as a whole, and how important is the material taken? A small amount is not automatically fair if what was taken is significant; copying a large amount is not automatically resolved by labeling the use realistic.
- Effect on the potential market or value: Could the game substitute for the original or affect a relevant market for the source or its licensed uses? The answer depends on the material and the use, not on a general claim that a game is transformative or noncommercial.
The Copyright Office says its Fair Use Index overview was last updated in July 2026 and is not comprehensive or legal advice. For a game asset, use the factors to frame the analysis rather than to promise a result.

Work through the decision before building or shipping the asset
- Identify the source. Record whether the reference is an actual vessel, historical plan, photograph, licensed asset, public-domain material, or another game’s design. Keep track of who created or owns the material and any license terms.
- Separate the elements. Note whether the game uses functional or commonplace features, an overall hull or deck form, a specific drawing or model, ornamental surface art, or branding. One asset can include several categories.
- Check whether Chapter 13 is relevant. Compare the vessel and design with the statutory definitions instead of assuming every real, fictional, or virtual ship qualifies. The applicable requirements are in Chapter 13 of Title 17.
- Assess fair use against the actual source. Ask what purpose the game serves, what expression it takes, how much and which parts it uses, and whether the use could affect a relevant market. Consider all four statutory factors together.
- Check other rights and territories. Ownership, license terms, public-domain status, trademark or trade-dress concerns, and laws outside the United States are separate questions; this copyright and fair-use overview does not resolve them.
For a close recreation, commercial release, unclear ownership, or unresolved licensing question, obtain advice from a qualified lawyer familiar with the relevant rights and jurisdiction before relying on a fair-use conclusion.
