The key questions are how the game is operated and whether players stake money or money-convertible items in expectation of a return—not which device they use. A purely offline game may sit outside the statutory definition, but the law does not create a blanket exemption for console or PC games.
What the law means by an online game
The Promotion and Regulation of Online Gaming Act, 2025 defines an “online game” as a game played on an electronic or digital device and “managed and operated as a software through the internet or any other kind of technology facilitating electronic communication.” That wording is not limited to mobile apps. An online PC or console game can meet the definition if its operation fits those terms. The Act, section 2(1)(f)
The definition does not separately explain offline games or expressly exempt them. A game played entirely offline, with no operation through internet or other electronic communications technology, appears not to meet the definition; hybrid arrangements may need closer examination of how the particular game works. This is a reading of the statutory wording, not a published platform-by-platform ruling by the Authority.
How common gaming scenarios differ

The dividing line: stakes and expected winnings
An “online money game” is an online game in which a user pays a fee, deposits money, or provides another stake in expectation of monetary or other enrichment in return. The definition applies whether the game involves skill, chance, or both. “Other stakes” include things convertible to money, such as purchased credits, coins, tokens, or objects. E-sports are excluded from this definition. The Act, sections 2 and 5

For a particular game, the important questions are what the player puts at risk, what return the player expects, and whether rewards or in-game assets can be redeemed or monetised outside the game. The 2026 Rules’ classification factors also include the provider’s revenue model and external monetisation. The Authority may assess the actual mechanics and operation; a label such as “skill game,” “social game,” or “console title” does not settle the legal classification. PIB summary of the 2026 Rules
That is why a standard purchase price or subscription should not be confused with a wager. Conversely, calling an item “virtual” does not by itself resolve whether it is a stake: the question is whether it is convertible to money and whether the game involves the required expectation of enrichment.

Social games and e-sports have distinct treatment
Online social games
The Act permits online social games for entertainment, recreation, or skill development, including games that charge a subscription or one-time access fee when the payment is not a stake or wager and the game does not involve the defined expectation of monetary winnings. Social games are not all automatically subject to registration. Under the 2026 Rules, registration applies to social-game categories that the Central Government notifies, taking account of factors such as user risk, scale, transactions, and country of origin. E-sports
The Act defines e-sports as organized multiplayer competition under predefined rules, recognized under sports law and registered as required, with outcomes determined by player skills such as dexterity, agility, or strategy. Entry fees may cover competition or administrative costs, and performance-based prize money may be allowed; bets and wagers are not. What providers and players should know about the current framework
The Promotion and Regulation of Online Gaming Rules, 2026 came into force on 1 May 2026 and establish the Online Gaming Authority of India (OGAI). The Authority’s determination process may begin on its own initiative, after an application by a provider seeking to offer a game as an e-sport, or following a government notification requiring classification of a social-game category. The Act prohibits offering, operating, facilitating, advertising, or promoting online money games, and also prohibits participating in them. It bars banks, financial institutions, and other payment facilitators from enabling transactions for online money gaming services. For an initial offence of offering such a service, the Act provides for up to three years’ imprisonment, a fine up to one crore rupees, or both; it also provides for blocking online money gaming services in specified circumstances. The Rules set risk-appropriate user-safety and grievance requirements for online game service providers. Measures include age verification or gating, time restrictions, parental controls, reporting tools, counselling support, and fair-play monitoring. A user with an unresolved grievance may take it to OGAI within 30 days and may then appeal to the MeitY Secretary as appellate authority. PIB summary of the Rules
