It depends on your country, the game’s exact rating, the seller’s rules, and any parental controls. In the U.S. ESRB system, “Mature 17+” and “Adults Only 18+” are separate categories: M is generally suitable for ages 17 and up, while AO is intended only for adults 18 and up. A rating is not automatically the same thing as a law or a guarantee that a retailer or platform will allow access.
What does “18+” mean in the U.S.?
“18+” is not a universal rating label. The ESRB is the rating organization used for U.S. games, and its categories distinguish between Mature (M) and Adults Only (AO). Check the exact rating and content descriptors shown on the game’s packaging or digital storefront rather than relying on a general “18+” description. The ESRB rating guide explains the categories and the content they identify.
| ESRB category | Age guidance | What to take from it |
|---|---|---|
| Mature (M) | “Content is generally suitable for ages 17 and up.” | This is the U.S. category commonly confused with “18+”; it is not the same as AO. |
| Adults Only (AO) | “Content suitable only for adults ages 18 and up.” | This is the ESRB category specifically limited to adults in its age guidance. |
Is it illegal for someone under 18 to play one?
A rating label alone does not answer every legal question. It is important to distinguish the rating organization’s content guidance from a country’s law, a retailer’s sale policy, and a platform’s account or parental-control settings.
In Brown v. Entertainment Merchants Association, the U.S. Supreme Court case document describes a California law that would have prohibited sales of certain violent games to people under 18, a First Amendment challenge, and the permanent injunction against enforcement by the lower courts. That case is relevant to that U.S. legal dispute; it does not establish the rules in every jurisdiction or resolve every question about a particular sale, platform, or family decision. Read the Supreme Court case document.

If you are outside the U.S., do not assume ESRB guidance applies. Storefronts may display regional systems such as PEGI as well as ESRB, and local law and seller policies may differ. Check the rating and rules for your location.
Can a store refuse to sell the game?
Yes. Retailer policy can restrict a sale even when the rating itself is not a blanket legal ban. The ESRB Retail Council code says participating retailers should maintain policies against selling or renting M-rated games to people under 17 and AO-rated games to people under 18. The code describes commitments by participating retailers; it is not a statutory rule that necessarily applies to every seller. See the ESRB Retail Council information.

Historical FTC undercover-shop surveys show why a retailer’s policy should not be mistaken for a guarantee of enforcement. In a survey conducted from November 2010 through January 2011, 13% of unaccompanied 13- to 16-year-olds surveyed were able to buy an M-rated game, compared with 20% in the 2009 survey, according to the FTC’s 2011 release. A separate survey conducted from April through June 2012 also found that 13% of underage shoppers surveyed bought an M-rated game, unchanged from 2010, according to the FTC’s 2013 release. These are dated findings about retail purchases, not current estimates or evidence about online play.

Many gaming devices include parental controls that can restrict games by rating. ESRB explains that such controls can block games based on their ratings and help manage play. ESRB parental-control guidance describes the general approach. On Nintendo Switch, Nintendo’s support guidance covers setting restrictions by age rating through parental controls: Nintendo Switch age restrictions.

How to check a game before playing
- Identify the rating system and region. Confirm whether the listing uses ESRB or another local system; do not treat every “18+” label as equivalent.
- Read the exact age category and content descriptors. The ESRB rating and descriptors appear on physical packaging and digital storefronts; use them to understand why a game received its rating.
- Check the seller’s access rules. Retailers and digital storefronts may have their own age-verification or sale policies.
- Review device and account restrictions. A parent or guardian may manage rating-based access through built-in parental controls.
- When outside the U.S., check local requirements. Regional rating systems and laws differ, so an ESRB label alone may not tell you what applies where you live.
