New York filed a lawsuit against Valve on February 25, 2026, alleging that paid loot boxes in Counter-Strike 2, Team Fortress 2 and Dota 2 amount to illegal gambling under state law. The case turns in part on the state’s claim that rare virtual items can be resold for money. The allegations have not been adjudicated, and the filing is not a finding that Valve broke the law.
What New York alleges
The People of the State of New York, represented by Attorney General Letitia James, filed the complaint against Valve Corporation in New York County on February 25, 2026. It invokes New York Executive Law § 63(12). The complaint names the Counter-Strike, Team Fortress and Dota franchises; James’s announcement specifically identifies Counter-Strike 2, Team Fortress 2 and Dota 2.
According to the state, players pay for keys that open virtual containers and award one item from a randomized selection. New York argues that the combination of payment, chance and the alleged monetary value of rare items makes the mechanic illegal gambling under state law. That is the state’s legal theory, not a court’s conclusion.
Why resale value matters to the case
The complaint’s argument depends in part on the claim that some virtual items have value beyond their use in a game. New York alleges that items can be traded or sold through Steam’s marketplace and third-party marketplaces, and that rare items can therefore produce monetary returns. The complaint’s description of those avenues and their significance is part of the plaintiff’s allegations; the sources available for this article do not establish a court finding about the value or typical saleability of any item.

James’s announcement cited a reported sale of an item for more than $1 million in June 2024. That is an example attributed to the Attorney General, not a verified typical price or evidence that most items can be sold for substantial sums.
What New York wants the court to do
The Attorney General’s announcement says New York seeks to stop the conduct it alleges is illegal, recover alleged ill-gotten gains and impose fines. These are requested remedies. The filing itself does not grant an injunction, award money or establish liability.

What is known about the case’s status
The primary materials identified for this article establish that the complaint was filed and describe the relief New York requests. They do not establish a later ruling, a change in the case’s status or a merits decision. The complaint records the state’s claims; it is not a judicial determination. Accordingly, Valve’s liability remains unresolved in the available information.

James said in the announcement: “Illegal gambling can be harmful and lead to serious addiction problems, especially for our young people.” This is the Attorney General’s statement explaining the suit, not an independent finding about the effects of these particular game features.
