Who was Nintendo’s lawsuit against?
The court record identifies the defendant as Gary Bowser. It does not identify a person or organization called “Penix 3D,” so that part of the supplied title cannot be confirmed. The case was Nintendo of America Inc. v. Gary Bowser, Case No. 2:21-cv-00519-RSL, in the U.S. District Court for the Western District of Washington. The case number and parties appear in the court’s final judgment.
“Bowser” here means Gary Bowser, not Nintendo’s fictional character. The judgment concerns circumvention devices and Nintendo intellectual property, with Nintendo Switch consoles and software in the case background.
What did the court order?
On December 7, 2021, Judge Robert S. Lasnik signed a stipulated final judgment awarding Nintendo of America Inc. US$10 million against Gary Bowser and imposing a permanent injunction. The order states: “Plaintiff is hereby awarded judgment against Defendant in the amount of US$10,000,000.00.” The parties consented to entry of judgment; it was not merely a requested amount.

The judgment invokes the Copyright Act and other authorities in setting out the injunction. Its terms are part of the court’s December 7, 2021 final judgment.
What the judgment does—and does not—establish
The order establishes the amount awarded and the injunction entered in this case. It is not, by itself, a complete account of every allegation or of what happened later in efforts to collect the award. The available court document also does not establish the judgment’s current collection status or resolve what “Penix 3D” refers to.

The $10 million figure is the case-specific amount ordered against Gary Bowser. It should not be treated as an estimate of industry-wide losses or as a general measure of the scale of game circumvention.
