Nintendo Targeted Switch Emulator Repositories With DMCA Notices—but the Campaign Isn’t Over

Nintendo’s DMCA campaign has reached named Switch emulator repositories and large GitHub fork networks. Here’s what the notices and Yuzu judgment establish—and what they don’t.

No public record establishes that Nintendo took down every Switch emulator. Nintendo has used DMCA notices to target named repositories and fork networks on GitHub, including a reported August 2026 sweep affecting more than 400 repositories. That count is not a count of distinct emulator projects, and the available records do not establish that every project, mirror, or off-GitHub copy is gone.

What Nintendo’s takedowns actually cover

The word “every” overstates what the public record can verify. Nintendo has repeatedly asked GitHub to remove specified repositories, sometimes applying a notice across a repository’s fork network. A repository is a place where code is hosted; hundreds of affected repositories can include copies and forks of the same project rather than hundreds of separate emulators.

In an August 2026 notice, GitHub said it had processed a Nintendo notice against a Suyu repository and a fork network of 311 repositories, including the parent repository. Separately, TorrentFreak reported that seven notices affected more than 400 repositories in a single day that month. The latter is a reported repository count, not an independently verified count of distinct, active emulator projects.

Nintendo’s March 27, 2026 notice named repositories offering or linking to Citron, Eden, Ziunx, Nyushu, Suyu, and Yuzu. An earlier notice, dated July 5, 2024, named Yuzu-based repositories including Suyu, Nuzu, Uzuy, Torzu, and Sudachi. These are examples of projects or repositories identified in particular notices, not a complete inventory of Switch emulators.

What a GitHub DMCA notice means

A DMCA notice is a rights holder’s request to a platform, not a court judgment. Nintendo’s notices set out the company’s allegations and identify material it wants removed. GitHub’s public notices say the platform contacted some or all affected repository owners and provided information about filing counter-notices. A repository can therefore be disabled through GitHub’s process without a court issuing a new ruling about that repository.

Nintendo’s stated argument focuses on technological protection measures. In its notices, the company says Switch games are encrypted and alleges that emulators use unauthorized copies of cryptographic keys to decrypt unauthorized game copies. Those statements describe Nintendo’s position in its takedown requests; they should not be read as findings about every emulator named in a notice.

What the Yuzu case decided—and what it did not

The clearest court outcome in this record is the 2024 case Nintendo of America Inc. v. Tropic Haze LLC, concerning Yuzu. The parties jointly moved for entry of judgment. The U.S. District Court for the District of Rhode Island awarded Nintendo US$2.4 million and entered a permanent injunction against Tropic Haze and covered parties.

The judgment states: “Yuzu is primarily designed to circumvent and play Nintendo Switch games.” It also describes Yuzu decrypting Switch games during runtime using unauthorized copies of cryptographic keys. Those findings and the injunction concern Yuzu and the defendant and covered parties named in the judgment. This was not a contested appellate ruling declaring every emulator unlawful, and the order should not be expanded to unrelated developers.

A separate October 2025 document involving Keighin was a magistrate judge’s recommendation in a default case focused on alleged piracy and streaming behavior. It was not a contested test case resolving the general legality of emulators. Likewise, reporting in October 2024 said development of Ryujinx stopped after contact from Nintendo; the court records described here do not establish a Ryujinx judgment.

Why the story is not over

Nintendo’s notices and GitHub’s processing show that the company continues to pursue alleged circumvention through platform takedowns. The August 2026 actions demonstrate that one notice can reach a large fork network, but they do not prove that every copy or distribution channel has been removed. The records reviewed do not verify the live availability, maintenance, or functionality of every emulator, fork, mirror, or self-hosted distribution channel as of October 8, 2026.

The practical distinction is between documented actions and a universal status claim: particular repositories and networks have been targeted, while the status of all Switch emulator projects and copies remains unestablished. The public record supports neither a claim that emulation has ended nor a claim that every project remains available.
