That warning means a later change or update can leave the console or its software unable to function. No authoritative consumer failure rate or “brick probability” has been established, so claims that a particular method is safe should be treated skeptically.
Warranty and repair eligibility
Nintendo states that damage caused by unauthorized circumvention products is not covered by its warranty. Service policies are regional and can change, but an unauthorized modification can make diagnosis, paid repair, replacement, or warranty service more difficult or ineligible.

Updates and online services
Nintendo warns that a console using an unauthorized device may stop working after a network update. Bypassing console or software protections also conflicts with restrictions in the User Agreement. Online access, account functions, updates, and multiplayer availability may therefore be interrupted or restricted.
Security, stability, and data
Unofficial code and hardware are not vetted by Nintendo. They can introduce crashes, corrupted or lost saves, incompatible updates, or malicious software. Will Nintendo ban a modded Switch?
A ban is possible, but no trustworthy public percentage predicts whether a particular modified console or account will be banned. Nintendo can restrict online services, reject network updates, or take account action when activity violates its agreements. A console that remains usable offline is not necessarily safe for online play, and avoiding a ban does not remove warranty, security, or legal risks.
Does jailbreaking void the warranty?

A safe, non-operational decision checklist
- Identify the goal. Decide whether you are seeking homebrew experimentation, accessibility, preservation, repair, or something else. If the goal is playing copied commercial games, recognize that this adds a separate copyright issue.
- Read the current terms. Review Nintendo’s User Agreement, warranty, and support rules for the console’s region. These documents can change.
- Assume services may be affected. Plan as though online access, updates, repair eligibility, and stored data could be lost or disrupted.
- Protect lawful saves. Use Nintendo-supported backup or transfer options where available. Do not copy or download unauthorized game files.
- Use official repair for faults. For a malfunctioning console, start with Nintendo troubleshooting, official support, or an authorized repair route instead of an unauthorized modification.
- Get local legal advice when needed. If the consequences matter to you, ask a qualified lawyer in the relevant jurisdiction rather than relying on forum summaries.
What U.S. law does—and does not—allow
The U.S. Copyright Office describes Section 1201 of the Digital Millennium Copyright Act as a general prohibition on circumventing technological measures that control access to copyrighted video games and software. Regulations include narrow, temporary, purpose-specific exemptions for activities such as certain diagnosis, maintenance, repair, and preservation.

Those exemptions are not a blanket consumer authorization to jailbreak a Switch for homebrew or piracy. They also do not legalize copyright infringement, distribution of unauthorized copies, trafficking in circumvention devices, or breach of Nintendo’s platform agreement.
