Apple accepted the submission later that day, so the dispute did not leave the store permanently blocked. The reversal resolved the immediate obstacle, but it was not a legal finding that Apple had violated the DMA.
What Apple rejected—and why Epic objected
Epic was seeking notarization for an iOS version of the Epic Games Store intended for users in the European Union. Epic said Apple rejected the submission twice, objecting to the design and placement of the store’s “Install” button because it looked too much like Apple’s “Get” button. Apple also objected to the “In-app purchases” label, which it considered too similar to the App Store’s “In-App Purchases” wording. Contemporaneous reporting on Epic’s account of the rejections said Epic described the terms as ordinary conventions used by other app stores and iOS apps.
Epic called the rejections arbitrary and obstructive, and said it had referred the matter to the European Commission. Its complaint was that a gatekeeper should not be able to make a rival marketplace’s approval harder by imposing its own interface conventions on routine controls. That is Epic’s allegation, not an established legal conclusion about the buttons or the labels.
Notarization is not ordinary App Store review
The submission was part of Apple’s EU alternative-distribution notarization system, not simply a standard request to list an app in the App Store. Apple describes notarization as a security and platform-integrity process for apps distributed outside its store. It includes automated checks and a basic human review, and is more limited than the traditional App Store review process. Apple’s EU developer documentation sets out the distinction and the safeguards.

- App Store review: Apple’s traditional review for apps distributed through the App Store.
- Notarization: Apple’s review process for apps and alternative marketplaces distributed outside the App Store under the EU framework.
- Marketplace approval: A separate process for a third-party store to be installed and distribute apps to users.
Apple’s published framework retains security requirements for alternative distribution; the DMA does not require Apple to approve every submission without review. Apple says its checks protect users, privacy and platform integrity. In principle, Apple can also argue that interface rules help users understand what they are installing. The available reporting on this incident, however, does not establish a separate, detailed Apple defense of the two specific button and label objections.
What the DMA requires—and where the dispute sits
The central distribution rule is Article 6(4) of the DMA. The European Commission says designated gatekeepers must allow apps to be distributed on their operating systems through channels other than their own app stores, including alternative marketplaces and, subject to applicable requirements, direct web distribution. The Commission’s developer guidance on app distribution also describes related rules on steering users to other purchasing channels, payment options and fair, reasonable and nondiscriminatory access.

Apple’s DMA page identifies iOS, the App Store, Safari and iPadOS as designated gatekeeper services. The Commission designated iOS, the App Store and Safari on September 5, 2023, and iPadOS on April 29, 2024, according to Apple’s account of its DMA obligations. The alternative-distribution changes discussed here concern apps distributed to users in the EU’s 27 member countries; they did not create a global right to install third-party iPhone stores.
That obligation does not settle whether a particular rejection is lawful. The relevant questions include whether a requirement is applied consistently and transparently, is proportionate to its purpose, discriminates against a competitor, or makes alternative distribution ineffective in practice. Epic argued that demanding changes to common interface elements could delay its launch and undermine the DMA’s promise of competition. Apple’s published security framework shows that review remains part of the system, but it does not by itself resolve whether these particular objections were justified.

Why the rejection mattered beyond two interface labels
Epic and Apple were already in a prolonged conflict over App Store rules, payments, Fortnite and alternative distribution. In March 2024, Apple terminated Epic Games Sweden’s developer account; Apple later said it would reinstate the account after engagement with the European Commission. Epic documented its account of that episode in a statement on the termination. The history helps explain why both companies had reason to frame the July dispute as evidence of the other’s intentions, but it does not prove that the notarization rejection was unlawful.
Epic’s broader concern was that a platform could formally permit alternative marketplaces while using approval conditions to delay or weaken them. Apple’s countervailing concern, as reflected in its published rules, is that alternative distribution must retain security and user-protection checks. Whether a specific condition crosses the line depends on how it works in practice, not just on the fact that Apple has a review process.

Apple reversed the rejection the same day
After Epic publicized the dispute and escalated it to the Commission, Apple accepted the previously rejected submission later on July 5, 2024. Contemporaneous reporting on the reversal describes the acceptance as occurring that day. Apple therefore did not permanently block the submission at issue.
Acceptance removed the immediate notarization obstacle. It did not, on its own, prove Epic’s legal case or amount to an admission by Apple that its earlier objections were unlawful. Nor did the dispute establish that the store would be available outside the EU or that every other requirement for installation and operation had disappeared.

What the European Commission later found
The Commission’s April 23, 2025 enforcement actions provide important context, but they should not be confused with a ruling on Epic’s two July 2024 submissions. In one action, the Commission said Apple’s contract terms for alternative app distribution were preliminarily viewed as breaching the DMA. In a separate matter, it found Apple in breach of the DMA’s anti-steering obligation. The Commission’s announcement on alternative-distribution terms and its announcement on Apple and Meta describe those broader enforcement matters.
Those actions show that the Commission scrutinized Apple’s implementation of the DMA, but the cited findings do not establish that the two button-related rejections themselves violated the law. The precise conclusion remains narrower: Epic alleged an unlawful obstruction, Apple later accepted the submission, and the immediate dispute was not resolved by a published legal determination about those two rejections.
