Potentially—but there is no blanket permission to show news footage simply because a stream reports news or is live. Section 52(1)(a)(iii) of India’s Copyright Act, 1957 recognizes fair dealing for reporting current events and current affairs. Whether a particular use qualifies depends on its purpose, relevance, context, and the amount used. The law does not provide a universal seconds-based safe harbour, and a legal argument does not guarantee that YouTube will leave a stream uninterrupted.
What Indian law allows
The Copyright Office, Government of India, summarizes section 52(1)(a) as allowing fair dealing with works for specified purposes, including research, criticism or review, and reporting current events and current affairs. The provision expressly includes “the reporting of current events and current affairs, including the reporting of a lecture delivered in public.” For a news livestream, reporting current events and current affairs is the most directly relevant purpose. See the Copyright Office summary and the text of Chapter VIII of the Copyright Act.
A stream that analyzes an event may also raise criticism or review, depending on what the footage is being used to criticize or review. But putting footage into a program that discusses news does not, on its own, establish fair dealing. The dealing itself must be fair and connected to a statutory purpose.
The Act defines communication to the public broadly, and its definition of broadcast includes communication by wireless diffusion or wire. A public livestream may therefore engage rights of communication to the public. That does not settle whether a use infringes copyright: statutory exceptions remain relevant. The Act’s definitions appear in Chapter I.

How courts assess whether a use is fair
Fair dealing is not specifically defined in the Act. In a 2026 judgment, the Delhi High Court said courts assess it case by case, considering context, purpose, and the extent and length of the material used. The Court also said there is “no universal standard” that applies across all cases. Read the Delhi High Court judgment, 2026:DHC:2339-DB.
That makes “How many seconds can I use?” the wrong question to rely on as a legal rule. The more useful question is whether this particular excerpt is needed for the reporting or analysis, and whether its use is proportionate to that purpose. Neither the cited statute nor the judgments establish a universal time limit.

Use that is more closely tied to reporting or analysis
A stronger fact pattern is one in which the stream is genuinely reporting or discussing a current event, the clip illustrates or substantiates a point, the host provides meaningful context or commentary, and only the amount needed for that purpose is used. These factors help frame the analysis; they do not guarantee a legal outcome.
Use that is harder to justify
A stream that rebroadcasts a segment so viewers can watch it instead of the source, uses lengthy material without meaningful commentary, or includes footage unrelated to the report presents a weaker case. In Super Cassettes Industries Ltd. v. Hamar Television Network Pvt. Ltd. (Delhi High Court, 24 May 2010), the Court considered music used in news programming. In the examples before it, the music was not relevant to the news reports; the Court emphasized both the quantity and qualitative importance of what was taken. The case concerned music and television programming, not a definitive ruling on every kind of footage in a YouTube livestream, so it is guidance on relevance and fairness rather than a direct answer for every stream. Why broadcast footage can raise an additional issue
If the excerpt comes from a television or other broadcast, section 39 may also be relevant. It addresses broadcast reproduction rights and performer rights, and includes use, consistent with fair dealing, of excerpts of a broadcast in reporting current events and certain other stated purposes. Consider it alongside section 52 rather than assuming that section 52 alone answers every rights question.
The material may involve more than one right or rights-holder. Do not assume that a news channel owns every element in a clip or that only one permission or exception is relevant. The applicable rights depend on the material and its ownership; the statutory text is in Chapter VIII.

What does not automatically make a clip lawful
- Attribution: naming the broadcaster or creator does not, by itself, establish fair dealing.
- A disclaimer: a disclaimer does not turn an otherwise unfair use into a permitted one.
- Not monetizing: non-monetization is not an automatic defence under the cited provisions.
- Keeping it short: a short clip is not automatically lawful, and there is no universal seconds limit.
- Calling the stream news: a news-related subject does not make every use of footage fair; relevance and purpose still matter.
Fair dealing and YouTube enforcement are separate questions
Whether a use has a legal basis under Indian copyright law and whether YouTube issues a claim or interrupts a stream are distinct questions. The legal sources cited here do not establish that a use with an arguable fair-dealing basis will avoid platform action. Do not treat a fair-dealing assessment as a guarantee against a claim or disruption.
A practical review before going live
- Identify the purpose. Write down what current event you are reporting or what point you are analyzing. A general news theme is not enough by itself.
- Connect each excerpt to that purpose. Be able to explain what the footage demonstrates or why it is relevant to the commentary.
- Limit the use to what the point requires. Consider both duration and the qualitative importance of the material; there is no fixed number of seconds that settles the question.
- Check what the clip contains and who may hold rights. Broadcast footage can raise section 39 issues as well as section 52 questions, and a clip may contain material with different rights-holders.
- Plan for platform action separately. A legal view does not guarantee that YouTube will not issue a claim or interrupt the stream.
This is general information, not a legal determination about a particular clip. If you are planning a high-stakes broadcast, have received a claim, or face a threatened legal action, consult an Indian copyright lawyer about the actual footage and use.
