हाँ। भारत में रहने वाला uploader YouTube से हटाए गए video के लिए counter notification भेज सकता है, अगर उसे सद्भावपूर्वक लगता है कि removal गलती या misidentification के कारण हुआ। यह कानूनी अनुरोध है—सिर्फ भारत में होना या थोड़ी सामग्री इस्तेमाल करना अपने आप में पर्याप्त आधार नहीं है। भेजने से पहले YouTube की कानूनी घोषणाओं, निजी जानकारी साझा होने और अमेरिकी jurisdiction से जुड़ी शर्तों को समझें।
पहले पता करें कि YouTube ने कौन-सी कार्रवाई की
“लाइव बंद हो गई” और “copyright takedown” एक ही बात नहीं हैं। YouTube Help के अनुसार, live streams को तीसरे पक्ष की सामग्री से मिलान के लिए स्कैन किया जाता है। कार्रवाई का प्रकार पहचानने के लिए YouTube Studio में दिखा notice पढ़ें।
- लाइव स्ट्रीम में interruption या termination: YouTube पहचानी गई सामग्री हटाने या रोकने की चेतावनी दे सकता है। सामग्री जारी रहने पर stream अस्थायी रूप से बाधित या समाप्त हो सकती है। यह अपने आप formal copyright removal request या strike के समान नहीं है।
- Formal copyright removal request और strike: यह कानूनी copyright removal request के बाद की कार्रवाई है। Counter notification इसी प्रक्रिया के तहत हटाए गए video के लिए है। यदि removal scheduled है, तो removal प्रभावी होने से पहले counter notification दाखिल नहीं किया जा सकता।
- Archived livestream पर Content ID claim: Stream पूरी होने और archive होने के बाद claim लग सकता है। यह formal takedown से अलग है; Studio में दी गई कार्रवाई और उपलब्ध उपाय देखें।
YouTube की strike जानकारी के मुताबिक, copyright के कारण सक्रिय livestream हटाए जाने पर strike के साथ सात दिन का live-streaming access restriction हो सकता है। यह restriction और strike अलग असर हैं।
भारत का copyright कानून क्या बताता है
Copyright Act, 1957 की धारा 51 copyright infringement से संबंधित है। धारा 52 में कुछ निर्दिष्ट उद्देश्यों और शर्तों के अधीन ऐसे कामों के अपवाद हैं जिन्हें infringement नहीं माना जाता; इनमें कुछ प्रकार की fair dealing शामिल है। किसी गेम, संगीत, फिल्म, खेल प्रसारण या अन्य संरक्षित सामग्री का इस्तेमाल किसी खास livestream में अपवाद के अंतर्गत आता है या नहीं, यह उपयोग के तथ्यों और लागू शर्तों पर निर्भर करता है।

YouTube की counter-notification guidance fair use, fair dealing और public domain को ऐसी संभावित वजहों के उदाहरण के रूप में बताती है जिनसे removal गलती या misidentification हो सकता है। इसका मतलब यह नहीं कि YouTube भारतीय कानून के तहत आपके उपयोग की वैधता का अंतिम निर्णय करता है। केवल “मैं भारत में हूँ” या “मैंने थोड़ा ही इस्तेमाल किया” कहना वैधता स्थापित नहीं करता।
Counter notification भेजने से पहले ये बातें तौलें
- आपका आधार वास्तविक हो: आप मानते हों कि removal गलती या misidentification के कारण हुआ। इसे सामान्य appeal या claim से असहमति जताने का तरीका न समझें।
- दाखिला कानूनी अनुरोध है। YouTube की मांगी हुई घोषणाएँ देना और उनके संभावित परिणाम समझना जरूरी है।
- YouTube counter notification claimant के साथ साझा करता है। उसमें दी गई संपर्क जानकारी निजी नहीं रहती।
- भारत से आवेदन करने वाले व्यक्ति के लिए YouTube की US jurisdiction घोषणा के भारतीय कानूनी निहितार्थ प्रकाशित मार्गदर्शन में स्पष्ट नहीं हैं। यदि इस बात को लेकर संदेह है, तो भेजने से पहले योग्य भारतीय वकील से सलाह लें।
YouTube counter notification कैसे दाखिल करें
- Studio में हटाए गए video का notice खोलें। पुष्टि करें कि यह formal copyright removal है, न कि केवल archived stream पर Content ID claim या live interruption।
- स्थिति जाँचें। यदि removal अभी scheduled है, तो YouTube के अनुसार removal प्रभावी होने से पहले counter notification दाखिल नहीं किया जा सकता।
- Counter notification का विकल्प चुनें। YouTube Studio के जरिए आवेदन किया जा सकता है। YouTube के निर्देशों में ईमेल, fax या mail से आवेदन के विकल्प भी दिए गए हैं।
- मांगी गई पहचान और संपर्क जानकारी दें। इसमें पूरा कानूनी नाम, भौतिक पता और फोन नंबर शामिल हैं। हटाए गए content का सीधा link दें और अपने शब्दों में संक्षेप में समझाएँ कि आपको removal गलती या misidentification क्यों लगता है। यदि कोई प्रतिनिधि आवेदन कर रहा है, तो uploader से उसका संबंध बताना होता है।
- घोषणाएँ ध्यान से पढ़ें और तभी हस्ताक्षर करें। YouTube निर्धारित US federal-court jurisdiction के प्रति सहमति और claimant से legal service स्वीकार करने की घोषणा मांगता है। साथ ही perjury penalty के तहत यह good-faith declaration चाहिए कि सामग्री गलती या misidentification के कारण हटाई गई। पूरा कानूनी नाम signature के रूप में देना होता है।
- निजी जानकारी साझा होने का असर समझें। YouTube आवेदन claimant को भेजता है। YouTube के अनुसार, जानकारी साझा करने को लेकर चिंता हो तो अधिकृत प्रतिनिधि—जैसे वकील—के माध्यम से आवेदन करने का विकल्प है।
भेजने के बाद क्या हो सकता है
YouTube पहले यह तय करता है कि counter notification वैध है या नहीं। यदि वह उसे valid मानकर claimant को भेजता है, तो claimant के पास YouTube की प्रक्रिया के तहत 10 US business days होते हैं कि वह content की बहाली रोकने के लिए कानूनी कार्रवाई का सबूत दे। यह YouTube की प्रक्रिया की समय-सीमा है, भारतीय अदालत की समय-सीमा नहीं।

यदि उस अवधि में YouTube को कानूनी कार्रवाई का सबूत नहीं मिलता, तो YouTube के मुताबिक content बहाल किया जाता है—जब तक uploader ने उसे delete न किया हो—और संबंधित strike हट सकती है। यह नतीजा या तय अवधि की गारंटी नहीं है: counter notification का valid माना जाना और claimant को भेजा जाना जरूरी है।
अगर counter notification नहीं भेजना चाहते

गेमप्ले, गेम का soundtrack, दूसरे broadcaster का feed या stream में चलाया गया कोई अन्य संरक्षित content अलग-अलग अधिकारों और परिस्थितियों से जुड़ सकता है। इस लेख में किसी खास गेम, संगीत, प्रसारण या license की जाँच नहीं की गई है; इसलिए किसी विशिष्ट stream के fair dealing या दूसरे अपवाद में आने का निष्कर्ष यहां से नहीं निकाला जा सकता। अपने notice, इस्तेमाल की गई सामग्री और अधिकार के आधार को साथ देखकर निर्णय लें।
YouTube ने 2022 में 16 मिलियन से अधिक videos के लिए copyright removal requests मिलने की सूचना दी थी। यह मंच-स्तर का कुल आंकड़ा है; इससे भारत में takedown की दर, गलत removals की संख्या या किसी व्यक्ति के counter notification के सफल होने की संभावना पता नहीं चलती।
