In the United States, owning a game cartridge or disc does not automatically make it lawful to download a ROM of that game from an unauthorized website. A download creates a copy, and the copyright owner generally controls reproduction. Federal law does allow some computer-program copies in limited circumstances, but those rules do not establish a blanket right to obtain any ROM because you own the original. Other countries may treat the question differently.
Why owning the cartridge or disc is not enough
Owning a physical copy is not the same as owning the copyright. Under 17 U.S.C. § 106, the copyright owner has exclusive rights that include reproducing a copyrighted work and distributing copies, subject to statutory limitations. A ROM download makes a digital copy; the fact that you own a cartridge or disc does not by itself authorize that separate copy.
The source matters. A download offered with the copyright owner’s authorization is different from one offered by an unknown or unauthorized site. The central question is not simply whether you own the game, but whether the copying is authorized or fits a particular legal exception.
What the U.S. backup rule in § 117 actually allows
17 U.S.C. § 117 provides limited permissions to an owner of a copy of a computer program. It covers another copy or adaptation when it is an essential step in using the program with a machine and is used in no other manner, and it permits a copy made “for archival purposes only.” An archival copy must be destroyed if continued possession of the program ceases to be rightful.

These conditions do not amount to a general permission to download a ROM from a third party or to make every kind of personal backup. Section 117’s application to a particular game, copy, license, and technical process can depend on the facts; the statute alone does not decide every console-game backup situation. It also limits transfer of copies prepared under the section: an exact copy may be transferred only with all rights in the program, and adaptations have an additional authorization condition.
Copying and bypassing access controls are separate issues
Even if a copying argument applies, it does not automatically resolve whether obtaining the ROM required bypassing an access control. Under the Digital Millennium Copyright Act, 17 U.S.C. § 1201 generally restricts circumvention of technological measures that control access to copyrighted works. The U.S. Copyright Office describes limited exemptions adopted through periodic rulemaking; they are specific exceptions, not a general license to download or share ROMs.

The current video-game provisions appear in 37 C.F.R. § 201.40. One narrow category permits certain circumvention related to restoring personal local gameplay in a lawfully acquired, complete game after the game owner or authorized representative has ceased access to an external authentication server. The regulation defines cessation to include an affirmative statement that support has ended and is unavailable, or support discontinued for at least six months and not subsequently restored. Local gameplay means play on a personal computer or console, or locally connected computers or consoles—not play through an online service or facility.
Other provisions address preservation by eligible libraries, archives, or museums, with limits on purpose and access. A separate institutional category concerns certain games that no longer require an external server and are no longer reasonably available commercially. These institutional rules do not create a consumer right to download any unavailable or abandoned game.

The Copyright Office records October 28, 2024 as the final-rule date for the 2024 Section 1201 proceeding. Its 2027 proceeding page says current exemptions, if renewed, would remain in force for an additional period from October 2027 to October 2030; that renewal proceeding is active. The exact rule in force can change, so consult the regulation for the applicable date.
How the common situations differ

Practical answer before downloading
- Identify the source: Is the download authorized by the rights holder, or is it an unverified third-party copy?
- Separate the acts: Consider the copying question independently from any circumvention of access controls.
- Do not assume ownership settles it: Having the physical game does not itself prove that a third-party ROM download fits § 117.
- Check the relevant jurisdiction and date: U.S. exceptions are specific and can change; other countries have their own rules.
