Copyright rules and federal anti-circumvention rules are separate questions, and the current video-game exemptions cover specific situations rather than a general personal-backup right.
What U.S. law does—and does not—say
Section 1201 of the Copyright Act addresses circumvention of technological measures that effectively control access to copyrighted works. The U.S. Copyright Office reproduces the statute’s baseline: “No person shall circumvent a technological measure that effectively controls access to a work protected under this title.” The statute also provides a periodic process for adopting limited exemptions. A personal-use purpose or ownership of a disc is not, by itself, an automatic answer to whether a particular circumvention is permitted.
Making a copy and circumventing an access control are distinct legal issues. The fact that you own the original does not resolve both. Nor do the available federal sources establish that every personal PS2 or original Xbox image is unlawful. The answer depends on the facts, including the title, the measure involved, the act performed, and whether a current exemption applies.
Why the current video-game exemptions are narrow
The current temporary exemption in 37 CFR 201.40(b)(19) addresses defined circumstances, not every game a person owns. Its categories include certain lawfully acquired complete games that require authentication from an external server after the copyright owner or its representative has ceased providing that server. In a specified case, the rule allows circumvention for copying or modifying a game to enable personal local gameplay; the regulation defines that term and sets conditions.

The rule also provides limited preservation routes for eligible libraries, archives, and museums. One concerns certain games tied to discontinued external-server authentication, subject to additional conditions. Another concerns qualifying complete games that do not require an external server and are no longer reasonably available in the commercial marketplace. These institutional provisions are not a general permission for an individual to make a personal backup.
The U.S. Copyright Office says its tenth triennial rulemaking is underway and existing exemptions are being considered for renewal for October 2027 through October 2030. Exemptions are temporary and cycle-specific, so check the current text of 37 CFR 201.40 and the Copyright Office’s Section 1201 proceedings information before relying on one.

PS2 and original Xbox backups use different technical routes

These are the emulator projects’ technical instructions, not legal opinions. They describe ways to create or prepare files; they do not establish that every step is legally permitted in every situation.
What you need for the PS2 route
Disc imaging
PCSX2 describes PS2 discs as unencrypted CDs or DVDs and documents ordinary optical-drive dumping on Windows, macOS, and Linux. If your computer lacks a suitable drive, its instructions identify an external USB optical drive as an option for this PS2 workflow. Check the specific drive’s media support and compatibility before buying; the documentation does not endorse a particular model.

PCSX2 notes that an imperfect dump can cause problems in a game and describes a verification process to help determine whether a dump succeeded. Follow the project’s current disc-dumping instructions and verification steps rather than assuming that a created image is complete merely because a file appeared.
BIOS files
The game image is not the only requirement. PCSX2 says its BIOS files are proprietary, are required to run games, and must be dumped from the user’s own PS2. Its BIOS guidance is separate from its disc-dumping instructions: an optical drive helps with the disc workflow, not with obtaining BIOS files.

What you need for the original Xbox route
xemu’s instructions describe Xbox-specific ways to prepare game files: transfer files over FTP from a real Xbox running a custom dashboard, or use a specially reflashed DVD drive. The resulting game needs to be in XISO format for xemu. If starting with a full Redump-style image, the project says its second partition must be extracted or repacked because the complete two-partition image is not directly compatible.
Do not assume an ordinary USB DVD drive used for a PS2 disc will also read and produce a usable original Xbox backup. xemu documents different approaches for Xbox discs. Its project says game files should come from a real physical copy, disallows sharing games through its channels, and does not endorse piracy; that is the project’s stated position, not a legal determination.

Before making an image, separate the legal and technical checks
- Identify your jurisdiction. The explanation here uses U.S. federal law. It does not determine the law in other countries or resolve state-law questions.
- Identify the exact act and access control. Making an image, bypassing an access measure, and using an emulator are not interchangeable legal questions. Determine whether the method you plan to use circumvents a measure that controls access to the work.
- Check whether a current exemption actually fits. Compare the game and circumstances with every condition in 37 CFR 201.40(b)(19), including the rule’s requirements concerning external-server authentication, local gameplay, commercial availability, or eligible preservation institutions, as applicable. Owning a disc alone does not satisfy those conditions.
- Use the correct technical instructions for the console. Follow PCSX2’s guidance for PS2 disc images and BIOS, or xemu’s guidance for original Xbox XISO files. Technical compatibility does not answer the legal question.
The cited federal materials do not establish a blanket U.S. personal-use exemption for copying any PS2 or original Xbox disc, and they do not support the opposite blanket claim that every such image is unlawful. A fact-specific decision with meaningful legal consequences may warrant advice from a lawyer familiar with the relevant jurisdiction and copyright law.
