Is downloading a game from Vimm’s Lair legal?
Legality depends on the game, the source and the law that applies where you live. Nintendo says that uploading or downloading unauthorized copies of Nintendo games is illegal, and directs players to official channels for authentic Nintendo games. That is Nintendo’s guidance about its games, not a jurisdiction-neutral legal ruling about every platform. Owning a cartridge, by itself, does not establish that downloading a copy from an online archive is lawful. How to find an authorized copy
- Check the platform’s official store. Search the relevant console or device’s store for the title and confirm that it is available in your region.
- For Nintendo games, use Nintendo’s stated official channels. Nintendo says authentic games can be purchased through Nintendo eShop on Nintendo devices; games developed for smart devices may be available through Google Play or the Apple App Store. - Consider an authorized physical release. Check that the seller and copy are legitimate, and that the release works with your device and region.
- Check the rules for your location before relying on an archival exception. A rule about making or retaining a backup does not automatically authorize downloading someone else’s copy.
Emulation, archives and game files are different questions
Emulation software, visiting an archive and acquiring a copyrighted game file are not interchangeable acts. The sources cited here address unauthorized game copies and a narrow U.S. backup-copy provision; they do not establish a blanket legal status for emulation. Assess the software and the game copy separately under the law that applies to you.
