Spoilers for Act 3 and the ending: Neither choice is objectively best. Free Orpheus to support his rebellion against Vlaakith, but the Emperor will abandon you and join the Netherbrain. Side with the Emperor to keep his help through the final confrontation, but Orpheus will be assimilated. The decision also determines who may become a mind flayer and how Lae’zel and Voss respond.
What happens if you free Orpheus or side with the Emperor?

The game’s reference entry says the Emperor defects because it believes Orpheus wants to kill it and it is acting for its own survival (bg3.wiki: The Emperor). The available outcomes do not establish one route as universally safer or stronger in combat; this is primarily a choice about allies, sacrifice, and the Githyanki story.
Check that you can free Orpheus before refusing the Emperor
The Orphic Hammer is normally required to break the two crystals binding Orpheus. Raphael may offer the hammer in a deal involving the Crown of Karsus. Alternatively, you can refuse the deal and steal it from the House of Hope. Previous dealings with Raphael affect the final Astral Prism fallback, so do not assume you can reject the Emperor and still free Orpheus without a viable route to the hammer. A party without the hammer or a viable Raphael deal can reach a game-over state after rejecting the Emperor.
- Before proceeding, check that the Orphic Hammer is in your inventory.
- If you do not have it, make sure you have a viable Raphael-related option before committing to the Orpheus path.
Who has to become a mind flayer?
Freeing Orpheus does not force the protagonist to transform. An illithid is needed to wield the Netherstones, but on this path the choice can be the protagonist, Karlach, or Orpheus. That makes the cost a decision among personal sacrifice, a companion’s sacrifice, and Orpheus’s sacrifice.

Who transforms changes what happens after the final battle, especially whether Orpheus can lead the rebellion himself.
How do Lae’zel and Voss react?
If Orpheus is assimilated, Lae’zel may turn hostile when she has rejected Vlaakith and embraced Orpheus. A difficult Persuasion check can prevent that outcome; it is not accurate to say she always leaves or always becomes hostile. Voss may also turn hostile, with the result depending on prior events and checks. If these characters matter to your ending, consider your story state and be prepared for dialogue checks before choosing the Emperor’s plan.

What happens to Orpheus after the final battle?
If Orpheus becomes a mind flayer
After the battle, Orpheus asks to die. A DC 20 Persuasion check can convince him to live, after which he disappears. This route saves the protagonist and Karlach from transforming, but leaves Orpheus unable to lead the rebellion in person.
If you or Karlach transforms
Orpheus thanks the person who took on the transformation, prepares to lead a rebellion against Vlaakith, and invites Lae’zel to join him. Lae’zel’s response depends on your playthrough.

Which choice should you make?
- Choose Orpheus if freeing him and supporting the Githyanki rebellion matter more to you, and you have secured the Orphic Hammer.
- Choose the Emperor if you want to preserve his assistance through the final confrontation and accept losing the Orpheus path.
- On the Orpheus path, decide who should bear the transformation—you, Karlach, or Orpheus—based on the ending you want for them.
There is no universal best ending established by these outcomes. Weigh the ally you want, who you are willing to see transform, and whether you want Orpheus to have a chance to lead the rebellion.
