You need rights to rebroadcast the specific episodes and every protected work they contain, and any Content ID rights holder should allowlist your channel. Before you go live, confirm the permission, the archive plan, and the allowlist status with the relevant rights holders.
What must be cleared before streaming podcast episodes
A podcast episode can include more than the host’s recording: music, interview clips, sound effects, and other third-party material may have separate rights holders. The podcast’s producer may not control all of them. YouTube’s livestream terms put responsibility on the provider to have the necessary rights for the live content worldwide, including music licensing rights where applicable. Read YouTube’s livestream terms and conditions.
Get permission for the actual livestream use
Ask the podcast owner or other relevant rights holders to confirm in writing that your permission covers continuous rebroadcast on YouTube. Check that it also covers your intended territories, monetization, the length of the permission, and whether the broadcast may be retained as an archive or replay. A general permission to use an episode may not answer those specific questions.
Check rights to material inside each episode
Confirm that the permission covers the episode recording and any embedded third-party works, such as compositions, sound recordings, clips, interviews, or effects. If separate permissions are needed, identify the rights holders and obtain them before broadcast. YouTube’s terms specifically refer to music licensing rights from artists, record labels, publishers, and other royalty participants.

Ask Content ID owners to allowlist your channel
If a rights holder uses Content ID, ask that owner to add the exact YouTube channel to its Content ID allowlist. YouTube warns that licensed third-party material may still interrupt a livestream when the channel is not allowlisted. YouTube’s live-stream copyright guidance explains allowlisting.
What YouTube may do during or after a 24/7 stream
YouTube scans live streams for third-party content matches. If it detects material, it may warn you, replace the stream with a placeholder image, temporarily interrupt the broadcast, or terminate it if the material remains. Detection is not certain for every episode, but you should plan for the possibility of a match even when you believe the content is licensed. Decide whether to keep the livestream archive
If you choose to archive the broadcast, YouTube says Content ID claims may be made after the livestream ends. Decide whether retaining a replay is necessary, and make sure your permissions cover that use before enabling an archive. Turning off the archive does not establish that the live broadcast itself is cleared or prevent live-stream detection.
Understand claims, interruptions, and strikes separately
A Content ID claim is not the same thing as a copyright removal request or a copyright strike. A claim can block a video, monetize it (sometimes sharing revenue), or track its viewership, and its effect can vary by territory. A livestream can also be interrupted or terminated under YouTube’s live-stream rules. YouTube explains the possible effects of Content ID claims.

Permission and automated matching address different issues: permission concerns whether you have rights to use the material; Content ID may still identify a match. YouTube specifically advises creators with licensed third-party content to ask the owner to allowlist their channel.
Does fair use protect a podcast livestream?
Not automatically. YouTube describes fair use as case-specific, and automated systems such as Content ID do not decide whether a use is fair. Copyright exceptions also differ among jurisdictions. If you believe a claim is mistaken, YouTube has a dispute process, but disputing a claim does not ensure that a match or live interruption will not happen first. Read YouTube’s fair-use guidance.

Whether a particular episode can lawfully be rebroadcast depends on the actual recording, the rights chain, the written permissions, the relevant territories, monetization, archive settings, and allowlist status. YouTube’s platform guidance does not determine the legal rights for a specific podcast or settle jurisdiction-specific questions.

- Identify the exact episodes and every potentially protected recording or work included in them.
- Obtain permission for a continuous YouTube livestream, covering intended territories, monetization, duration, and any retained archive.
- Confirm that permission covers embedded works or obtain the additional licenses required from their rights holders.
- Ask each relevant Content ID owner to allowlist the exact channel, then verify the change with that owner before going live.
- Choose whether to retain an archive and confirm that your permissions cover the replay.
- Have a response plan for a YouTube warning, placeholder, interruption, or termination; do not assume a licensed stream will be uninterrupted.
