How an Indian Radio Station Can Make a YouTube Livestream Comply With Music Copyright Rules

An Indian radio licence may not cover YouTube. Check rights for the composition, recording, live transmission, territories, and replay—and coordinate Content ID allowlisting.

Before an Indian radio station streams music on YouTube, it should verify permission for both the musical works and the specific sound recordings, and confirm that permission covers live online transmission, the relevant territories, and any archived replay. Do not assume an over-the-air licence covers YouTube. Legal permission and YouTube’s Content ID systems are separate: even a licensed stream can be interrupted if the rights owner has not allowlisted the channel.

What a station needs to clear

A YouTube music stream raises more than one rights question. The Copyright Act, 1957 protects communication of works to the public, and making content available by diffusion can fall within that right. A station therefore needs to assess its public YouTube transmission, not just its studio equipment or terrestrial broadcast permissions.

A recording can involve distinct rights in the underlying composition and lyrics and in the particular sound recording. The Copyright Office’s Hand Book of Copyright Law explains that playing a sound recording may require attention to public-performance rights in the music as well as permission relating to the recording, depending on the repertoire and relevant rights societies. A licence covering one layer should not be treated as proof that every layer is cleared.

Material or use What to verify
Musical work Permission for the composition and lyrics, where applicable, for the planned public transmission.
Specific sound recording Permission for the recording the station intends to play, not merely the song title or composition.
Live YouTube transmission That the permission covers online live transmission on YouTube, the intended territories, and the licence term.
Replay, clips, or promotion Whether the permission also covers an archived stream, extracts, and promotional use. These uses may be outside a live-broadcast grant.
Guests and commissioned material Whether guest performances, arrangements, or other contributed material have the permissions needed for the same uses.

Why a radio licence may not settle YouTube rights

Section 31D of the Copyright Act and Rule 29 of the Copyright Rules describe a statutory-licence framework for eligible broadcasting organisations communicating previously published literary or musical works and sound recordings, subject to statutory conditions and administrative processes. Those provisions do not, by themselves, establish that a particular terrestrial or radio-broadcast licence covers a YouTube stream.

A music-industry representation hosted by TRAI recounts a Bombay High Court interpretation that Section 31D did not extend to internet broadcasting organisations. That is a stakeholder’s account, not the judgment itself, so it should be treated as a reason to investigate rather than a conclusive answer. The station’s actual agreements, repertoire, intended territories, current legal authorities, and the law’s application to its service all matter.

Before relying on Section 31D, a society licence, label agreement, or existing broadcast contract, have qualified Indian copyright counsel review the document and the proposed YouTube use. Check the exact grant, exclusions, notice and royalty terms, duration, territories, reporting obligations, and whether online transmission and replay are covered.

Clear the programme before scheduling it

  1. Build a track-by-track inventory. For each item, record the composition and lyrics, the exact recording, any guest or commissioned contribution, and the known rights owner or licensor. Include music in jingles, transitions, call-ins, and background beds—not only the main playlist.
  2. Match each item to written permission. Record who granted each right, which rights layer it covers, the permitted media and territories, the term, and any payment or reporting conditions. Confirm that YouTube live transmission is expressly covered or otherwise clearly included by the agreement.
  3. Decide whether the stream will be archived. If the station enables an archive, confirm that the rights also cover replay and any clips or promotional extracts the station plans to publish. YouTube says Content ID claims on an archived live stream may be made after the live stream ends.
  4. Ask rights owners about Content ID allowlisting. If a licensed track is in YouTube’s matching systems, ask the relevant owner or administrator to allowlist the station’s channel where applicable. Keep written confirmation and the channel identity with the programme records.
  5. Keep an audit trail. Retain licences, correspondence, track logs, notices, royalty records, and allowlist confirmations for the stream and any replay. Make sure the playlist actually played matches the cleared inventory.

Meet YouTube’s separate live-stream requirements

YouTube’s livestream terms require the provider to represent that it has the necessary rights to exploit live content on Google services, including music licensing rights, and to comply with applicable law. Separately, YouTube Help says: “All live streams are scanned for matches to third-party content, including copyrighted content in the form of another live broadcast.” If detected content remains, YouTube may interrupt or terminate the stream.

A licence does not necessarily stop an automated match. YouTube says a licensed stream may still be interrupted if the rights owner has not added the channel to its allowlist. Treat allowlisting as a platform-operational step, not as a substitute for obtaining rights. Likewise, a stream that passes live checks is not thereby legally cleared; an archived stream can receive a Content ID claim after the broadcast ends.

Use safer music sources when rights are unclear

  • Station-owned original music: Use it only after confirming the station controls the necessary composition and recording rights, including rights contributed by performers or collaborators.
  • Public-domain material: Check the status of both the composition and the specific recording. A composition’s public-domain status does not automatically make a modern recording free to use.
  • YouTube Audio Library: YouTube describes its Audio Library music and sound effects as copyright-safe. Read and follow the applicable terms for each item and use.
  • Third-party “free” tracks: Verify the actual licence. A “free” label or attribution in the description does not establish permission for commercial radio use, livestreaming, every territory, or an archived replay.
  • Creator Music: YouTube’s guidance says usage rules vary by track and region, and that Creator Music revenue-sharing tracks cannot be used in livestreams. Do not assume Creator Music clears a radio livestream.

Compare a licence with the planned use

Use these questions for each licence or music source; a yes on one dimension does not answer the others.

Check Question for the station
Rights layer Does the grant cover the musical work and the specific sound recording, as needed?
Use Does it cover terrestrial broadcast, live internet transmission, archive or replay, clips, and promotion as applicable?
Territory Where does the permission apply, and does that match the audience reach the station intends for YouTube?
Platform operations Must the rights owner or administrator allowlist the channel to avoid automated live interruptions?
Administration What notices, playlist logs, royalty payments, reports, and renewal dates are required?

Troubleshooting a blocked or claimed stream

  • YouTube interrupts the live stream after a music match: Check the alert and identify the matched recording. Pause or remove the disputed material while the station verifies its permission; contact the relevant rights owner about channel allowlisting. Do not assume a terrestrial licence resolves the match.
  • The station has permission, but matching continues: Confirm that the licence covers the exact recording, YouTube live use, relevant territories, and current dates. Then ask the rights owner or administrator whether the channel has been allowlisted. Keep the response with the licence records.
  • A claim appears after the stream ends: Review the archived content and the matched segment against the station’s rights documents. YouTube’s guidance notes that archived live streams may receive Content ID claims after the live event. Handle the claim using YouTube’s process and the actual licence evidence; do not dispute it solely because the stream was previously permitted to run.
  • A “free” track is flagged or challenged: Recheck the track’s licence for commercial broadcasting, live streaming, territory, and replay rights. Attribution alone does not cure a missing permission.
  • The station cannot identify all music in the programme: Do not treat the unknown portion as cleared. Remove or replace it with material whose composition and recording rights can be verified before scheduling another stream.
