You can capture a bound book with an overhead scanner, a library’s permitted equipment, or a personal camera—but owning the print copy does not automatically give you clear permission under U.S. law to scan an entire copyrighted book. Before you start, check the book’s copyright status and the rules that apply to your intended use. If you proceed, prioritize the book’s condition: support it rather than forcing it flat.
Check whether scanning is allowed
In the United States, books are generally protected by copyright when created and fixed. The Library of Congress explains that fair use is assessed case by case using four factors: the purpose and character of the use, the nature of the work, the amount used, and the effect on the work’s potential market or value. The U.S. Copyright Office likewise describes fair use as fact-specific. Neither source establishes a general exception allowing someone to scan a complete copyrighted book simply because they own a print copy or intend to use the scan privately.
That makes two distinctions important: owning the physical book is not the same as owning the copyright, and keeping a scan private is different from distributing or posting it. Personal purpose alone does not settle whether a complete scan is allowed. Public-domain status may change the analysis, but do not infer that a book is public domain only because it is old or lacks a copyright notice; verify its status. Choose a capture method that suits the book
There is no single best setup for every book. Consider how often you will scan, how many pages you need, the book’s size and binding, how far it opens safely, whether you need searchable text, and what equipment you can access. The key practical choice is whether your setup can capture the pages without stressing the spine or paper.

Prepare and capture the book safely
- Inspect it first. Look for weak joints, brittle or loose pages, a restricted opening, and foldouts. Do not force the book open. If it seems fragile or will not open safely, stop and ask a conservator or experienced library professional for advice.
- Support the binding. Choose a setup that holds the book in a safe position. The Library of Congress advises: “Don’t apply pressure to books in order to flatten them for image capture.” For books with weak joints or restricted openings, it recommends a book cradle—blocks or rolls of polyethylene foam—during image capture.
- Set up a clean workspace. Use a clean, roomy surface and keep food and drink away from the book. Handle brittle paper carefully, and do not remove foldouts to make scanning easier.
- Capture only if your intended use is permitted. Save page images and assemble them into a document only after considering the copyright rules that apply to the work and your use. Avoid treating a technically successful scan as proof that making it was legally permitted.
- Keep the files private unless sharing is authorized. Do not post or distribute a digital copy unless you have established that doing so is allowed.

Use a library’s equipment only under its rules
Before bringing a book to a library, ask about its scanner or camera rules, item-handling requirements, and copyright policy. The Library of Congress says its research centers set policies for personal laptops, scanners, and digital cameras; copying may also depend on an item’s physical condition, and copyright restrictions still apply. Other libraries set their own rules, so do not assume that equipment access means a particular book may be copied.

Decide what to do with the digital files
If you have established that the capture is allowed, organize the resulting images in a way that suits your needs. A page-image file preserves the captured appearance; searchable text requires text recognition, which may need correction. The available guidance does not establish scanner settings, capture speeds, OCR accuracy, or a best file format, so choose based on your device’s instructions and how you plan to read the files. Keep a copy secure, and do not share it unless you have verified that distribution is authorized.
