You can sell a rented property, but the sale does not end the tenancy. First decide whether the buyer will take over with the tenant in place or whether you need vacant possession. That choice affects the sale plan, access arrangements and—if you need the tenant to leave—the legal route and timing.
Choose between selling with the tenant in place and seeking vacant possession
A sale with the tenancy continuing may suit a buyer who intends to let the property. If the buyer does not plan to rent it, a vacant sale may be more straightforward, according to Sheffield City Council’s guidance on selling a tenanted property. This is practical guidance, not a guarantee about buyer demand or sale times.

Check the tenancy and possession route before setting a date
Review the tenancy agreement, start date, type of tenancy and any access terms. The route for recovering possession depends on the tenancy and applicable law. Do not promise a completion date that assumes the tenant will leave until you have checked whether the relevant process permits it and how long it may take.
England: Ground 1A for an eligible landlord intending to sell
For eligible tenancies in England, the Ministry of Housing, Communities and Local Government’s possession guidance, updated 1 May 2026, describes Ground 1A for a landlord intending to sell. It requires four months’ notice before applying to court, and a tenant cannot be required to leave within the first 12 months of a new tenancy. Notice can be served during that protected period, but it cannot expire before the period ends. The ground has eligibility limits, including exclusions for some older assured non-shorthold tenancies and most social landlords.

If the tenant remains after notice, you must apply to court for possession. Notice is not an eviction. Ground 1A is an England-specific route; do not assume it applies in Wales, Scotland or Northern Ireland. Check the rules for the property’s jurisdiction and tenancy before acting.
Arrange access without treating notice as automatic permission
Check the tenancy agreement before booking photography, valuations, surveys or buyer viewings. Shelter England says private assured tenants do not have to allow access for viewings, surveys, valuations or builders’ inspections unless the tenancy agreement requires it. The terms and circumstances matter, so agree reasonable times with the tenant and explain who will attend.

GOV.UK’s statement about giving 24 hours’ notice concerns access for inspection or repairs; it is not a universal right to conduct sale viewings. See GOV.UK’s renting rights and responsibilities and Shelter England’s access guidance. Do not enter without authority or pressure the tenant. Government consumer-protection guidance for lettings professionals states: “You should not use aggressive or deceptive means to gain access to the property, since doing so is likely to impact on the consumer’s contractual right to enjoy quiet possession of the property.” Read section 8.6 of the government consumer-protection guidance.
Check the EPC before marketing
Look for an existing Energy Performance Certificate before advertising. The domestic EPC guide for England and Wales says a certificate is valid for 10 years unless a newer one supersedes it. If no valid certificate exists, commission one from an accredited assessor. The energy rating must appear in commercial-media advertisements. See GOV.UK’s guide to Energy Performance Certificates. Keep the tenant informed and update the landlord details after completion
Tell the tenant about the intended sale and discuss access arrangements. If the tenancy continues after completion, give the tenant the new landlord’s name and contact details in writing. Sheffield City Council recommends notifying the tenant and warns that the seller could remain responsible for issues if they fail to do so. See its guidance on selling a tenanted property.
