To run a merch giveaway on a livestream, publish clear rules before accepting entries, explain how to enter and how a winner will be chosen, then contact the winner privately and ship the prize as promised. On YouTube, entry must be free, and the creator is responsible for the contest rules and prize administration. Requirements can also depend on where viewers live and on the platform you use.
Plan the giveaway before you go live
Choose a prize you can fulfill
Decide exactly what you are giving away: for example, a specific T-shirt design or hoodie. Set the available sizes and colors, the countries or regions you can ship to, who pays postage, and what you will do if the chosen item or size is unavailable. Do not announce a prize you cannot supply on those terms.
Set eligibility and timing
Write down who may enter, including any geographic limits, age minimum, employee or family exclusions, and platform account requirements. Set the opening and closing times, the number of entries allowed per person, and how duplicate or ineligible entries will be handled.
Choose one entry and winner process
A chat keyword can be simple, but the rules must say exactly which keyword counts, when it must be posted, and how the winner will be selected. State whether selection is random or judged, where and how the winner will be contacted, how long they have to claim, and what happens if they do not respond. Use the announced method consistently; do not promise a random draw and then choose a winner another way.

Publish official rules and protect entrant information
Make the rules accessible before anyone enters. YouTube says creators must have official rules and remain responsible for complying with applicable federal, state, and local laws and for administering the contest and awarding the prize. Its rules also require legally required disclosures, a privacy notice, links to the YouTube Community Guidelines, a statement that YouTube is not the sponsor and is released from contest liability, and compliance with the rules you publish. YouTube also prohibits requiring payment to enter and manipulating its views, likes, dislikes, or subscriber counts. Read YouTube’s contest policies.
For a U.S. sweepstakes-style promotion, do not make purchase a condition of entry: FTC small-business guidance says purchase-required sweepstakes are illegal in the United States. State rules may also require disclosures, licensing, or a bond. The applicable requirements depend on factors such as the entrant’s location, prize, and whether selection is based on chance or skill; the federal and platform guidance here is not a universal legal form. Explain what information you collect and why. You may need a winner’s name and shipping address, and apparel fulfillment may require size and color. Collect those details privately, use them only as disclosed, and do not ask entrants to post addresses in public chat. YouTube says not to request full rights or ownership of an entrant’s submission. Do not imply that YouTube sponsors or endorses the giveaway.
Run the giveaway on the platform you use
YouTube
Keep entry free, avoid tying entries to engagement metrics, and have the official rules and privacy notice ready before inviting viewers to participate. Do not run a contest through YouTube ad units. Read the entry instructions aloud or display them, including the prize, eligibility, closing time, selection method, and rules location.

Twitch places responsibility for legal compliance, rules, winner selection, prize delivery, expenses, and any required registrations or bonds on the promoter. It may remove a promotion it believes violates its terms or the law. Twitch also requires this disclaimer to be displayed or read aloud:

Whatnot
Whatnot describes free standard giveaways, follower-only giveaways, and buyer appreciation giveaways. Entry takes place in its app, random winners are announced during the show, and the seller pays shipping; format mechanics and availability can differ. These are Whatnot-specific rules and should not be copied into a giveaway on another platform. Check Whatnot’s giveaway help.

Before the stream
- Confirm the prize, available variants, shipping area, postage responsibility, and backup plan if the selected item is unavailable.
- Finalize eligibility, the entry window, entry limit, duplicate-entry handling, winner selection, contact channel, claim deadline, and alternate-winner process.
- Publish the official rules and privacy notice somewhere viewers can access before entering. Include all platform-required disclosures.
- Prepare a short explanation of the prize, how to enter, when entries close, how the winner is selected, and where to find the rules.
During the stream
- Explain or display the key terms before opening entries. On Twitch, include its required promotion disclaimer.
- Keep entry open only for the stated window and close it at the announced time.
- Select the winner using the stated method. Announce what happens next without revealing private contact or shipping information.
- If the merch or another brand is sponsored or gifted, disclose that relationship clearly. FTC staff guidance says livestream endorsement disclosures should be repeated periodically so viewers who only see part of the stream will receive them. Twitch says to use its branded-content tool when applicable; using the tool does not replace the creator’s legal responsibilities. Read the FTC’s influencer disclosure guidance and Twitch’s branded content policy.
After the draw
- Contact the selected entrant through the channel stated in the rules and verify only eligibility details you said you would verify.
- Collect necessary size, color, and delivery information privately. Give the winner the stated time to respond and follow the announced alternate-winner process if they do not.
- Ship the prize, keep an administration record consistent with the rules, and announce completion without sharing the winner’s private details.
Common mistakes to avoid
- Adding terms after entries open: Publish the rules first, then follow them as written.
- Making a YouTube entry depend on engagement: YouTube requires free entry and prohibits manipulating views, likes, dislikes, or subscribers.
- Using a purchase requirement for a U.S. sweepstakes: Keep a free entry route and check jurisdiction-specific obligations.
- Leaving the winner process vague: State the selection method, contact route, response deadline, and alternate procedure in advance.
- Collecting addresses in chat: Request shipping information privately and limit its use to fulfillment as your notice explains.
- Forgetting that live audiences arrive at different times: Repeat sponsor disclosures periodically rather than relying on one mention.
