A cartridge is a copy of the game, not ownership of its copyright. The U.S. Copyright Office says unauthorized downloading can infringe copyright, while its limited rule for archival copies does not create a general right to download someone else’s ROM. Nintendo says it does not authorize its game files for PC play or download. The official access routes identified here are for consoles or cloud play, not a PC game download.
What “emulator,” “ROM,” and “owning the game” mean
- An emulator is software that imitates a console so compatible games can run in another environment.
- A ROM is a copy of the game’s software. Downloading one from a website is a separate act from installing emulator software.
- A cartridge is a particular physical copy of the game. Buying it does not transfer the copyright in the game itself.
That last distinction appears in 17 U.S.C. § 202: “Transfer of ownership of any material object, including the copy or phonorecord in which the work is first fixed, does not of itself convey any rights in the copyrighted work embodied in the object.” The U.S. Copyright Office likewise says that downloading a protected work without the copyright owner’s authority can infringe the owner’s reproduction and/or distribution rights.
Does owning the cartridge make a downloaded ROM legal?
Not by itself. The Copyright Office’s guidance does not identify ownership of a separate copy as a general exception to its rule about unauthorized downloads. A ROM obtained from a third-party site does not become authorized simply because the downloader also owns a GoldenEye 007 cartridge.
The archival-copy rule is limited
The Copyright Office describes a narrow provision in 17 U.S.C. § 117: a lawful owner of a computer program may make or authorize an archival copy, subject to conditions. Among them, the archival copy must be destroyed or transferred with the original when the original is sold, given away, or otherwise transferred. The Office also notes that a sale’s terms or a license agreement may matter, and that this provision concerns computer programs—not other material, such as music or films downloaded to a hard drive.

This guidance is not a blanket permission to download a ROM from the internet whenever you own a cartridge. It also does not settle every question about extracting a copy from a cartridge, applicable license terms, anti-circumvention rules, or how another country’s law applies. If those details matter to your situation, consult a lawyer in the relevant jurisdiction.
Is an emulator itself illegal?
The sources cited here do not establish that every emulator is illegal. Emulator software and the copyrighted game files used with it are different things, so the legality of one does not automatically decide the legality of the other. The source of the game files and any circumvention involved can affect the analysis.

Nintendo’s FAQ warns against pirating or playing pirated Nintendo games and says Nintendo does not authorize its game files for PC play or download. That is Nintendo’s stated position; it is not a court ruling that determines the legality of every emulator design or use.
Preservation exceptions are not a public ROM license
U.S. regulations include defined video-game preservation exemptions for specified activities by eligible libraries, archives, or museums. The listed cases come with conditions, including requirements concerning lawfully acquired complete games and restrictions on access. They do not give the public a general license to download ROMs from an archive or website.

What official ways to play GoldenEye 007 are identified?
The official listings and announcements below describe console or cloud access, not a downloadable Windows PC version. They establish that licensed routes have existed in particular contexts, but do not confirm today’s catalog, subscription, purchase, cloud-play, or regional terms.

For a specific country or account, check the platform’s current official catalog and terms. A console or cloud option should not be described as a PC download unless the platform explicitly offers the game for PC.

What are the possible consequences of an unauthorized download?
The U.S. Copyright Office says statutory damages may reach $30,000 for each work infringed, or up to $150,000 per work if willful infringement is proven. These are statutory ceilings in the Office’s FAQ—not automatic fines, a prediction of a particular case, or a statement about outcomes in other countries.
What this means for someone who wants to play on PC
The sources identified here do not establish an authorized PC download of GoldenEye 007. They also do not make cartridge ownership a defense that automatically legalizes a third-party ROM download. If you want to play through a licensed route, check the current Xbox or Nintendo catalog for your region and platform; the routes described above are not evidence of a Windows download.
