For PS4 owners in the United States, obtaining or using unauthorized game copies conflicts with Sony’s software license, and bypassing access controls can also raise a separate issue under federal anti-circumvention law. The narrow U.S. exemptions for certain local-play and preservation uses are not general permission to pirate, copy, or share games.
What Sony’s PS4 software license says
Sony describes PlayStation software as licensed, not sold, and reserves intellectual-property rights to Sony and its licensors. Its U.S. PlayStation Product Software License Agreement says users may not obtain software outside SIE-authorized distribution methods. Its restrictions also cover copying or distributing software, unauthorized or pirated software, and tools used to circumvent encryption, security, or authentication mechanisms.
Sony’s U.S. PlayStation Terms of Service incorporates system-software and game-software license terms and makes access subject to applicable agreements and intellectual-property law. These are contractual platform rules; they are not, by themselves, a complete statement of every legal consequence that might apply.
Is PS4 game piracy illegal in the United States?
There are two distinct questions: whether conduct violates Sony’s agreement, and whether it violates a statute. Sony’s agreement restricts unauthorized acquisition and use as described above. Separately, Section 1201 of the U.S. Digital Millennium Copyright Act generally prohibits circumventing technological measures that control access to copyrighted works, including video games and computer software. The U.S. Copyright Office’s 2024 Section 1201 proceeding explains the general rule and the process for limited temporary exemptions.

Do video-game preservation exemptions make pirated PS4 games legal?
No. The current U.S. exemptions are narrow and conditional; they do not create blanket authorization for pirated copies, unauthorized distribution, or circumvention used to infringe copyright.

The current 37 CFR 201.40 includes limited circumstances involving certain lawfully acquired complete games. A local-gameplay exemption includes conditions concerning the end of external server support. Preservation provisions are limited to eligible libraries, archives, or museums and are subject to stated requirements. These exceptions do not amount to general permission for an individual to download, copy, or share a game.
The Copyright Office says the final rule for the ninth triennial proceeding was published on October 25, 2024; the statutory process establishes temporary exemptions for the ensuing three-year period. The rules can change, so the regulation and current Copyright Office materials matter for any specific preservation question.

What is the lawful alternative?
Use games obtained through SIE-authorized distribution methods, such as licensed digital purchases or authentic licensed PS4 game discs acquired through lawful channels. This avoids relying on an unauthorized copy and aligns with Sony’s stated software-license terms.
Why avoid assuming every console modification has the same outcome?
U.S. enforcement has included cases involving circumvention devices and unauthorized videogame use. For example, the Department of Justice’s 2020 Team Xecuter press release concerns alleged circumvention devices, but it is not a PS4-specific case and does not establish that every modification produces the same legal result. The applicable facts and law matter.
