The September 5, 2025 outcome was a stipulated judgment and permanent injunction—not a jury verdict. The court filing bears Daly’s signature marked “pro se”; Tom’s Hardware reported that he represented himself throughout the case.
Who was the judgment against?
Nintendo of America sued Ryan Michael Daly, doing business as Modded Hardware, in the U.S. District Court for the Western District of Washington. The case was Nintendo of America Inc. v. Daly, No. 2:24-cv-00958-GJL. The parties filed their joint stipulation on September 5, 2025, before Judge Grady J. Leupold. The filing identifies Daly as appearing pro se, meaning without a lawyer. Tom’s Hardware reported on September 8, 2025 that Daly represented himself throughout the case.
Why did Nintendo receive $2 million?
In their joint stipulation, the parties set out findings about devices and services Daly marketed, distributed, or sold. These included the MIG Switch and MIG Dumper, modchips, modified consoles, and modification services. The filing describes the MIG Switch as enabling access to and play of unauthorized or pirated Switch game copies, and the MIG Dumper as copying game cartridges to computers or external storage. It also states that, in connection with hacked consoles and services, Daly copied and distributed certain copyrighted Nintendo games to customers.
The stipulated findings say the marketing, distribution, and sale of the devices and services violated sections 1201(a)(2) and 1201(b)(1) of the Digital Millennium Copyright Act. They also say the copying and distribution of Nintendo games infringed copyright under section 501 of the Copyright Act. On that basis, the court awarded Nintendo of America US $2,000,000.00. The filing does not characterize that figure as a measurement of Nintendo’s economic losses.

What did the permanent injunction prohibit?
The injunction restricts Daly’s future involvement with circumvention devices and modified consoles, as well as related technology, instructions, and services. Among other things, it bars him from:
- Trafficking in, obtaining, or possessing covered circumvention devices and modified consoles.
- Helping create such devices or distributing related technology or instructions.
- Operating or linking to websites designed to help people access or obtain them.
- Specified reverse engineering and further copyright-infringing conduct.
The order also directs the surrender and transfer of the Modded Hardware domain to Nintendo’s control and allows covered devices and materials to be seized, impounded, or destroyed.

Was this a jury verdict, and is it the Gary Bowser case?
No. The result was a joint stipulation for entry of final judgment and permanent injunction, not a decision reached by a jury. Daly is also distinct from Gary Bowser, the separate defendant in Nintendo’s Team-Xecuter enforcement case; Bowser’s case and penalties should not be attributed to Daly.
The judgment establishes the award, but the filing does not establish whether Daly has paid it or what balance, if any, remains to be collected.
