Jane Doe’s civil complaint alleges that she was drugged and sexually assaulted by multiple men at Cornell’s Chi Phi fraternity house in October 2024. She reported the incident to Cornell campus police the following month, but the initial criminal investigation closed without charges after the Tompkins County district attorney reviewed a police summary. In late September 2026, the DA reopened the investigation; on October 1, Governor Kathy Hochul appointed New York Attorney General Letitia James as special prosecutor. What Doe alleges happened at Cornell
Doe’s September 2026 civil lawsuit alleges that, during the night of October 19 into October 20, 2024, she was pressured or forced to take drugs, became incapacitated, and was sexually assaulted by multiple men at the Chi Phi fraternity house. These are allegations in a civil complaint, not findings of criminal guilt. The defendants disputed some or all of the allegations, according to reporting on the court-filed materials.
The complaint also alleges that Cornell and other parties failed to protect Doe. Those claims remain part of civil litigation. Doe is identified here by the pseudonym used in court filings; her identity should remain protected.
Two separate processes followed her report
Doe reported the incident to Cornell campus police in November 2024. Cornell also opened a Title IX disciplinary investigation. That university process and the criminal investigation had different purposes and standards: a university disciplinary finding is not a criminal verdict, and the existence of a campus investigation does not establish that a crime occurred.

What the Title IX record does—and does not—show
The Associated Press reported that a portion of the Title IX records filed in court described 50 interviews with 32 witnesses and 12 days of hearings. Those figures refer to the portion of records AP described; they should not be treated as an official count of every investigative step in the case. Reporting also describes differing accounts and disciplinary findings, but the available summaries do not establish that the university process resolved every factual disagreement.
Why the first criminal investigation closed
Tompkins County District Attorney Matthew Van Houten said his office relied on a police summary and did not pursue charges. He later said the sworn police statement and summary he received did not include allegations of nonconsensual drugging, incapacitation, or forced sex.

Hochul publicly raised a different account of the information flow. She said newly reported details raised serious questions about the campus police investigation and that Doe’s statement expressing confidence that she had been raped was omitted from what police sent prosecutors. The DA said his office had not been provided the full picture. These statements establish a public dispute about what the prosecutor was told; without the complete underlying police file, the available reporting does not settle it.
Why the case was reopened, and who is handling it now
Doe filed her civil lawsuit in September 2026 against Cornell, seven former Chi Phi members, and other parties. The complaint alleges sexual assault and failures to protect her; its claims have not been adjudicated. In late September, after the lawsuit and renewed public reporting drew attention to the case, the district attorney announced that the criminal investigation had been reopened.

On October 1, 2026, Hochul appointed New York Attorney General Letitia James as special prosecutor. Hochul criticized the initial handling of the case. At an October 2 news conference, she said: “This woman, this young woman, had already endured something that is utterly unspeakable. And then at every turn, she was failed by people and institutions with an obligation to protect her.” That is the governor’s assessment of the institutional response, not a court finding.
James said her office would “review the facts, gather evidence, interview witnesses and, if warranted, pursue prosecutions.” Van Houten said he supported the appointment. The appointment gives the renewed investigation a new lead prosecutor; it does not itself establish that anyone committed a crime or guarantee that charges will follow.

As of October 3, 2026, the special prosecutor’s investigation was pending.
