Ubisoft’s U.S. EULA explicitly says the company may terminate its agreement when it decides to discontinue offering or supporting a product, and that users must then uninstall the product and destroy their copies. Other publishers also use destroy-copy language after termination, but the cited terms from Activision, Epic Games, Behaviour Interactive, and EA do not say that ending support itself automatically triggers the same duty. Contract wording is not a ruling on whether a clause is enforceable in every place or situation.
Does a server shutdown mean you have to delete a game?
Not necessarily. A game’s servers going offline and a license terminating are distinct events. Ubisoft’s U.S. EULA is unusually direct: it lists Ubisoft’s decision to discontinue offering or supporting a product as one event that makes termination effective. That is what the agreement says; it does not establish that a court would enforce the requirement in every jurisdiction or circumstance. Nor does the clause mean a publisher has physically taken back a disc. What Ubisoft’s clause says—and what happened with XDefiant
The EULA says either party may terminate it at any time and for any reason. Ubisoft termination takes effect upon notice, termination of the user’s Ubisoft account, or “at the time of UBISOFT’s decision to discontinue offering and/or supporting the Product.” It then states: “Upon termination for any reason, You must immediately uninstall the Product and destroy all copies of the Product in Your possession.” Ubisoft’s U.S. EULA

XDefiant shows why it helps to distinguish a service shutdown announcement from the contract’s termination language. Ubisoft announced on December 3, 2024, that the servers would remain active until June 3, 2025. Ubisoft’s XDefiant announcement Its legacy service list records the game with a June 4, 2025 date. Do other publishers have similar clauses?
Yes. The official terms reviewed for Activision, Epic Games Store, Behaviour Interactive, and EA also include language requiring users to stop using a product and destroy copies after termination. Their cited passages, however, do not identify a decision to end support as the termination trigger.

“Studio” is not quite the right label for every company here: Activision, Epic, EA, and Ubisoft are publishers or platform operators, while Behaviour Interactive is both a developer and publisher. The important distinction is the contract trigger, not the company label. A destroy-copy requirement after termination does not, by itself, show that support ending automatically terminates every publisher’s license.

- They do not make every shutdown equivalent to termination. Only Ubisoft’s cited U.S. EULA expressly includes a decision to discontinue offering or supporting a product as a termination event.
