You can build a UGC business by producing videos or other assets that brands can publish on their own channels or use in advertising. You are selling content and its agreed usage rights—not necessarily access to your own audience. Start with a clear format, make a small portfolio, pitch brands that fit your work, and put each deal’s scope and terms in writing.
For gaming creators, that might mean making a product demo, game-related explainer, or short promotional video for a brand. The precise work depends on the client and the permissions for the material involved; do not assume that a brand brief automatically grants rights to use third-party game footage, music, logos, or other material.
What a UGC business does—and what it does not
A UGC creator makes content a brand can use. In a production-only arrangement, the creator delivers the asset and the brand publishes it or runs it as an ad. The creator’s follower count may matter less than the quality, relevance, and usability of the work.
That differs from sponsored creator posting: the creator publishes to an audience they control, so the audience, platform, reach, and disclosure obligations are part of the deal. Some projects combine production and posting; others involve a brand using the creator’s content in paid advertising. TikTok for Business identifies branded content and Spark Ads as commercial UGC formats and notes that creators may grant advertising authorization. How to start a UGC business
- Choose a format or niche. Pick work you can make reliably, such as short-form demonstrations, explainers, or product-focused videos. A gaming focus can help you describe the kinds of briefs you want, but keep your offer specific rather than claiming expertise you cannot show.
- Create a small portfolio. Make sample work that demonstrates your approach and production quality. Label samples clearly; do not imply that a brand hired you if it did not. Before using a product, brand asset, game footage, music, or other third-party material in a commercial sample, check that you have permission for the intended use.
- Describe your deliverables. State the format, length or scope where relevant, file or version count, and what is included in the handoff. Say whether you will post anything from your own account; do not leave that obligation implicit.
- Find suitable brands and pitch directly. Choose companies whose products and intended audience fit the work in your portfolio. A short pitch can identify the content you make, point to relevant samples, and propose a specific deliverable. Avoid promising results such as sales or reach that you do not control.
- Agree on scope and terms in writing. Confirm what you will make, when it is due, what revisions are included, when payment is due, and how the brand may use the finished work. Save the agreed brief and any later changes.
- Deliver and keep records. Send the agreed files through the agreed channel, note completion and payment, and retain records of income and business expenses. Keep copies of the final scope and usage permission so you can tell what was licensed.
What should a UGC deal agreement cover?
There is no UGC-specific contract form established by the official guidance cited here. As a practical planning checklist, agree in writing on the points below before production begins. The right wording and legal effect can depend on the jurisdiction and deal, so a generic checklist is not a substitute for legal advice where you need it.

- Deliverables: the number and type of assets, formats, versions, and any raw footage or additional cutdowns included.
- Schedule: brief approval, draft and final delivery dates, and what happens if either side is delayed.
- Revisions: how many are included, what counts as a revision rather than a new request, and how additional work will be approved and paid.
- Payment: amount, invoicing method, payment timing, and any agreed milestones.
- Usage rights: the channels, territory if relevant, and duration for which the brand may use the work; distinguish ordinary posting from paid advertising.
- Advertising authorization: whether the brand may run the content as an ad, whether authorization through your account or identity is needed, and the platforms and duration involved.
- Exclusivity and cancellation: any limits on working with competitors, how long those limits last, and what happens to payment or work in progress if the project is cancelled.
- Posting and disclosure: whether you must post from your own account and who is responsible for supplying the information needed for accurate disclosures.
How to price the work without guessing at a market rate
There is no authoritative, representative UGC rate range established here, so an internet anecdote should not be presented as a standard or promise of typical earnings. Build a quote around the actual scope and rights instead of choosing a number based on someone else’s isolated deal.
- Define the deliverable and the production effort it requires.
- Estimate the time and cost for planning, filming or creating, editing, delivery, and the revisions included.
- Specify the permission being granted: organic use or paid ads, channels, duration, and any exclusivity.
- Price additional versions, raw footage, extended usage, or extra revisions separately when they are outside the agreed scope.
- State payment timing and check that the total makes sense for your costs, capacity, and the rights requested.
This is a quoting worksheet, not a numerical market-rate recommendation. Do not let a vague request for “full usage” obscure where, how long, or in what kind of media the content may appear.

Disclosures and platform rules
If content is an endorsement, disclose a material connection such as payment, a free or discounted product, or another perk. The FTC’s guidance says endorsements should be truthful, endorsers should not claim experience with a product they have not tried, and material connections should be disclosed. The FTC calls the Endorsement Guides guidance rather than regulations; it says failure to follow them may lead to an investigation under the FTC Act. The FTC’s disclosure advice is to put the disclosure with the endorsement, where it is hard to miss. Do not bury it in a profile, behind a “more” link, or among hashtags. Its brochure explains disclosures for social media creators: Disclosures 101 for Social Media Influencers.

TikTok says creators must use its content disclosure setting when a post promotes a brand, product, or service, including promotion of their own business; posts without the disclosure may be removed or restricted. Check TikTok’s current instructions before posting because controls can change: Promoting a brand, product, or service. Platform disclosure controls do not replace making the disclosure itself clear to viewers.

The IRS treats creative or professional services as gig work and says gig income must be reported even when the work is part-time or temporary, or when you do not receive an information return. Its current gig-work guidance says net self-employment earnings of $400 or more require filing a return for gig work. The IRS describes self-employment tax as Social Security and Medicare taxes. Topic 554 lists rates of 12.4% for Social Security and 2.9% for Medicare, while also noting an annual Social Security wage base and possible Additional Medicare Tax. Those rates do not, by themselves, calculate a creator’s full tax bill. See IRS Topic 554. State and local obligations depend on where you live and work. If you are outside the United States, use the tax rules and professional guidance for your jurisdiction.
