Video Copyright Rules for YouTube Creators

A practical guide to YouTube copyright: permissions, fair use by jurisdiction, Content ID claims, takedown notices, strikes, and response options.

You can use someone else’s material in a YouTube video only when you have the necessary rights or a valid legal exception applies. Giving credit, owning a copy, or using only a short excerpt does not automatically make it lawful. If YouTube reports a problem, first check whether it is a Content ID claim or a copyright removal request: they have different consequences and response options.

What copyright rules mean for gaming videos

Copyright generally belongs to creators of original work when it is created. That does not give you permission to use another person’s protected music, video, images, or other material in your own upload. Permission, a license, public-domain status, or a legal exception may provide a basis for use. YouTube’s copyright overview and copyright tips explain the platform’s general guidance.

For gaming creators, check the material in the finished video, not just the footage you recorded. A gameplay recording can contain game visuals, music, sound effects, dialogue, and third-party material added during editing. The applicable rights and any publisher policies may vary; do not assume that owning the game or recording your own session settles every rights question. Confirm that your intended use is covered before uploading or streaming.

Common assumptions that do not grant permission by themselves

  • Crediting the rights holder does not, by itself, authorize use.
  • Buying or owning a copy of a song, game, film, or image does not, by itself, grant a license to include it in a video.
  • A disclaimer or a particular number of seconds does not automatically make a use lawful.
  • A music source or other platform resource is not a guarantee that a video will avoid a claim or strike. Read the restrictions on the specific material and secure the rights you need.

Content ID claim vs. copyright removal request and strike

A Content ID claim and a copyright removal request are separate YouTube processes. A claim commonly affects a video and typically does not itself create a strike. A removal request is a legal request; if YouTube finds it appears valid, the video is removed and a copyright strike is applied. The exact restriction and available action depend on the notice in YouTube Studio.

Issue Content ID claim Copyright removal request / strike
What it is A claim generated through YouTube’s Content ID matching process. A legal request asking YouTube to remove content; an apparently valid request can lead to removal and a strike.
Typical consequence A claim on the video, not usually a strike by itself. Depending on the claim, availability or monetization may be affected. The video is removed and a copyright strike is applied if the request appears valid.
First response Dispute only if you have a valid basis, such as the necessary rights, a genuine legal exception, or a match made in error. The claimant has 30 days to respond. If YouTube schedules removal, follow the specific notice within its seven-day window. After removal, retraction or counter-notification may be options where the removal was mistaken or misidentified.
Legal significance A platform dispute does not mean YouTube has determined ownership or fair use. A counter-notification is a legal request, with required statements and disclosure of information to the claimant.

How YouTube detects and handles copyright issues

YouTube says uploaded videos are scanned against audio and visual reference material submitted by copyright owners through Content ID. A match may produce a claim, and the claim’s details determine whether it affects playback or monetization. A separate copyright removal request can lead to removal and a strike if the request appears valid. That a video has not been claimed yet does not establish that its use is authorized.

YouTube reported that it received copyright removal requests for over 16 million videos in 2022. This is YouTube’s historical count of videos covered by requests received that year—not a count of proven infringements, strikes, or current annual volume. Details are in YouTube’s page on copyright removal requests.

Fair use and other exceptions depend on where you are

Fair use is a U.S. legal exception for certain uses; it is not a universal YouTube rule. Other countries and regions may have different exceptions, including fair dealing, with different requirements. Check the law that applies to you rather than assuming a rule from another jurisdiction governs your video.

In the United States, do not reduce fair use to a fixed number of seconds, a credit line, or a disclaimer. YouTube says it cannot determine whether your use qualifies as fair use during a claim dispute. A claim or takedown can therefore occur even when you believe an exception applies. As YouTube puts it in its copyright tips, “Copyright isn’t decided by YouTube, it’s decided by law.” For a consequential dispute, consider getting advice from a qualified lawyer in the relevant jurisdiction.

What to do when YouTube reports a copyright issue

1. Read the exact notice in YouTube Studio

Identify whether Studio says “Content ID claim” or refers to a copyright removal request or strike. Check what material is identified, what restriction applies, and any deadline or action stated in the notice. Do not treat the two processes as interchangeable.

2. If it is a Content ID claim, dispute only on a genuine basis

You may dispute when you have the necessary rights, believe a legal exception applies, or can identify a mistake or misidentification. Gather the relevant license, permission, or other supporting information before responding. YouTube says the claimant has 30 days to respond to a dispute. Giving credit or owning a copy of the work is not, on its own, a valid reason to dispute. Review YouTube’s current claim-dispute steps and the notice’s specific consequences before proceeding.

3. If removal is scheduled, use the notice’s seven-day window carefully

YouTube says a scheduled removal gives the uploader seven days to take specified steps that may avoid removal and a strike. Depending on the notice and circumstances, these can include deleting the content, obtaining a retraction, or cancelling an appeal that triggered the scheduled request. Follow the options shown in your notice; do not assume every option applies to every case. See YouTube’s removal-request guidance.

4. If a strike has already applied, consider the available routes

YouTube describes three routes: complete Copyright School and wait 90 days, seek a retraction from the claimant, or submit a counter-notification if the removal was a mistake or misidentification. The 90-day expiration route depends on completing Copyright School and having fewer than three copyright strikes on the channel. Deleting the video after the strike has applied does not, by itself, resolve that strike. Check YouTube’s strike guidance for current instructions.

5. Treat a counter-notification as a legal request, not a routine appeal

A counter-notification asks YouTube to reinstate removed content. YouTube requires legal contact information, a concise explanation of the mistake or misidentification, links to the removed material, required legal and good-faith statements, and a legal-name signature. YouTube forwards the information to the claimant, so understand that disclosure before filing. Submit one only if you have a good-faith legal basis and are prepared for the possibility of legal action.

YouTube says that after it forwards a valid counter-notification, the claimant has 10 U.S. business days to provide evidence of legal action to keep the content down. If no such evidence is provided, YouTube says it will reinstate the content unless it has been deleted. The U.S. Copyright Office’s Section 512 report describes the statutory 10-to-14-business-day framework, subject to notice of qualifying legal action. These are U.S.-law procedures; consult current law and qualified counsel for a live dispute.

Reduce risk before uploading

  • List the music, footage, images, and other third-party material in your edit, including material captured inside a game.
  • For each item, confirm permission, a license that covers your intended use, public-domain status, or a legal exception that actually applies in your jurisdiction.
  • Keep copies of licenses and permissions, including any terms that limit territory, duration, monetization, or type of use.
  • Review the claim or restriction shown in Studio instead of assuming that a particular source or amount of material is automatically safe.
  • If using YouTube’s Audio Library or Creator Music, check the terms for the individual selection and use. YouTube says music-sourcing options do not guarantee avoidance of claims or strikes; its copyright overview explains the platform’s guidance.
