The Trump administration has used that process to ask the justices to let challenged policies take effect while lawsuits continue. Such an order can change what happens in the meantime; it does not, by itself, decide that a policy is lawful.
What is the Supreme Court’s shadow docket?
“Shadow docket” is a colloquial label, not the name of a separate court or one uniform procedure. The Congressional Research Service (CRS) uses “non-merits docket” for matters the justices handle outside the Court’s usual process for deciding cases on their legal merits. Emergency applications are one important part of that broader work.
The term can be misleading if it suggests that every matter is secret or unexplained. Emergency cases vary: some receive briefing and written explanations, while some orders are short and unsigned. The requests can come from public or private parties. In recent high-profile cases, many have concerned challenges to federal policies.
How does the Supreme Court emergency docket work?
A typical dispute starts when a lower court blocks or limits a policy. The party seeking relief can ask an appeals court, and then the Supreme Court, to intervene before the underlying lawsuit is finished. The justices may grant a stay or other interim relief that pauses the lower-court order. If they do, the policy may operate while the legal challenge proceeds.

That timing matters: an interim order can have significant real-world effects even though it is not a final judgment on the policy’s legality. The case may continue through the courts, and the Court may later consider the merits through its ordinary process. An emergency grant therefore should not be described as a final ruling that the government—or the challenger—is right.
How has Trump used the shadow docket?
The administration has repeatedly asked the Supreme Court for emergency relief after lower courts blocked or limited administration policies. Axios reported on September 29, 2026, that the administration had filed its 41st application since returning to office. The application, filed September 28, sought to let the Bureau of Prisons reinstate a policy cutting off some gender-affirming care for incarcerated transgender people. It was a request for interim relief, not a final decision on the policy.

The applications cover more than one policy area. The Brennan Center for Justice’s tracker lists disputes involving immigration and Temporary Protected Status, removals to third countries, federal agencies and employment, voting, and other administration actions. One prominent example is Trump v. CASA: emergency applications challenged nationwide injunctions against Trump’s birthright-citizenship executive order. The Supreme Court heard argument and issued an extensive signed opinion in June 2025, illustrating that a dispute that begins with emergency litigation can receive substantial consideration.
What do the application and outcome counts show?
There is no single count that answers how often the administration has sought relief and how often it has obtained it. The figures below count different things, cover different periods, and come from different sources.

These are not directly interchangeable totals. An application count is not a decision count; trackers can also differ in their cutoff dates and in whether they count cases, requests, decisions, or partial relief. “Won” can overstate what an interim order means: a grant may be partial, may come with little written explanation, and does not itself establish that the challenged policy is lawful. CRS also cautions that a government’s apparent success rate can depend in part on which cases it chooses to bring.
Why is the growing use disputed?
The administration’s argument
The administration says lower courts have issued an unusually large number of injunctions against its policies, and that those orders block actions it considers lawful while litigation can take years. Axios quoted White House spokeswoman Lauren Bis saying, “President Trump has faced a historically unprecedented number of injunctions by activist lower court judges.” Axios also quoted a Justice Department spokesperson defending applications when emergency relief is warranted. These are the administration’s explanations, not neutral findings about the number or merits of injunctions.

Critics’ concerns
Critics argue that fast emergency proceedings can put major policy disputes before the justices with limited explanation and can alter the practical status quo before lower courts finish their work. In April 2026, the Associated Press reported that Justice Sonia Sotomayor called the rise in emergency appeals “unprecedented in the court’s history.” AP also reported her concern that presuming irreparable harm to the government makes it harder for the opposing party to defeat an application. That is Sotomayor’s characterization and argument, not an independently established historical measurement.
CRS describes several possible contributors to the docket’s prominence: the government’s litigation strategy and choice of cases; lower courts’ use of nationwide injunctions; and possible changes in how justices apply emergency-relief standards. CRS notes that a nationwide injunction can prompt an emergency appeal because it bars the government from implementing a policy even against people who are not parties to the lawsuit. The available account does not establish one cause as the settled explanation for the trend.

What did Trump v. CASA change?
In June 2025, the Supreme Court limited the availability of nationwide injunctions but left open that they may be appropriate in some circumstances. CRS says it remains unclear how that decision will affect federal litigation or the government’s incentive to seek emergency relief. It therefore does not follow that applications will necessarily rise or fall as a result.
In a concurrence in Trump v. CASA, Justice Brett Kavanaugh argued that there often should be a nationally uniform answer about whether a major federal policy can be enforced during the years before a final merits decision. That was his view in a concurrence, not a holding that every challenged policy should take effect. In a dissent in Trump v. Wilcox, Justice Elena Kagan wrote that the emergency docket “should not be used to overrule or revise existing law.” Their statements capture a central disagreement: how to manage a policy’s reach during litigation without treating a temporary emergency decision as a final resolution of its legality.
