Check the giveaway’s published official rules before choosing what happens to an unclaimed prize. Confirm the claim deadline, how the winner was to be notified, what they had to do, and what the rules authorize if they do not respond. If the rules permit an alternate winner, follow that procedure consistently and keep records. There is no universal claim period or automatic right to keep, donate, or redraw a prize; the answer depends on the rules and applicable law.
Start with the rules that applied to the giveaway
Use the version of the official rules and promotion materials that applied while entries were being accepted. Look for these terms before contacting an alternate or deciding what to do with the prize:
- The deadline for claiming, including the time zone and how the deadline is calculated.
- The stated notification method and contact information the entrant was expected to monitor.
- The exact response steps, such as replying to a message or returning an eligibility affidavit, release, or tax form.
- What counts as a missed claim, and whether the rules allow disqualification, forfeiture, an alternate winner, or another remedy.
- Any limits on who is eligible, and the jurisdiction or other terms that may affect the promotion.
Do not substitute a deadline or consequence from another giveaway. For example, New York City Department of City Planning sample rules allow two days after an award notification is sent, and permit an alternate winner if the winner misses that period, is ineligible, or fails to return a required affidavit and release. That two-day period belongs to those sample rules; it is not a general standard. Read the NYC sample rules.
What organizers should do, step by step
1. Verify the original selection and the winner’s eligibility
Check that the draw or selection followed the method announced in the rules, then confirm the selected person meets the stated eligibility requirements. Keep a record of the selection and the basis for any eligibility decision. Do not treat a person as having forfeited simply because a message was sent; first check the deadline and the response requirements in the rules.

2. Notify the potential winner as the rules specify
Use the channel and address or account information specified in the rules. Include the exact steps needed to claim and the applicable deadline. Keep the date and method of each contact attempt, delivery status if available, and any response. Distinguish evidence that a notice was sent from evidence that it was received.
3. Request only required documents and protect them
Ask only for documents or information that the rules or applicable law require. If the claim involves an affidavit, release, or tax form, make clear which document is needed, how to return it, and by when. Handle personal information securely rather than collecting extra details for convenience.

4. At the deadline, document what happened
Record whether the required response arrived by the deadline and whether the claim requirements were met. If the winner responded or an issue arose near the cutoff, apply the rules as written rather than making an ad hoc exception. If the rules do not clearly address the situation, pause before reallocating the prize and get jurisdiction-specific advice when the value or uncertainty warrants it.
5. Use an alternate only if authorized
If the rules and applicable law permit an alternate, conduct and document the next selection as the rules prescribe. Check that the alternate is eligible, then repeat the same notice, claim, and documentation process. Do not assume that an alternate is automatically allowed just because the original winner did not reply.

Can you keep, donate, or redraw an unclaimed prize?
Do not decide based only on what seems fair or convenient. The rules may specify an alternate process or another disposition, while the governing law may constrain whether a prize can remain unawarded. Before retaining, donating, substituting, or leaving a prize unawarded, check both the promotion’s terms and the law for the relevant jurisdiction. If either is unclear, seek legal advice specific to the promotion.
Legal requirements depend on the promotion and location
Federal FTC guidance is limited to covered prize promotions
The FTC’s Telemarketing Sales Rule guidance addresses defined prize-promotion contexts involving covered sellers or telemarketers. It says covered promotions must disclose information including odds, a free way to participate, and material costs or conditions for receiving or redeeming a prize, and bars misrepresenting material aspects. Florida has specific rules for covered game promotions
Florida Statutes §849.094 applies to defined game promotions connected with promoting or selling consumer products or services where chance and a prize are involved. The presented 2024 Florida Statutes, including 2025C, prohibit arbitrarily disqualifying entries and failing to award prizes offered. For covered promotions with a total announced prize value above $5,000, the statute provides for advance filing of rules and prize information at least seven days before the promotion begins, security through a trust account or bond subject to a waiver route, and a certified winners list within 60 days after winners are finally determined. These are Florida-specific requirements, not nationwide rules; confirm the currently effective law and whether it applies to the promotion before acting. Consult the Florida statute and the Florida Department of Agriculture and Consumer Services summary.
