Fallout: New York went offline after its creator said ZeniMax Media contacted him about the fallout.nyc domain and intellectual-property rights. The project was described as a browser-playable Fallout fan game built with Claude and AI agents. PC Gamer writer Andy Chalk argued that this particular project’s close resemblance to Fallout made the reported intervention understandable—but that is an opinion, not a legal finding.
What happened to Fallout: New York?
Chris First presented Fallout: New York as a browser-playable game made by directing Claude and a group of AI agents. PC Gamer reported that it featured quests, dialogue trees, V.A.T.S. and a working Pip-Boy. Those features are descriptions from coverage, not the result of an independent playtest.
In a September 28, 2026 social post quoted by Yahoo Tech, First described the project this way: “Quests. Dialogue trees. V.A.T.S. A working Pip-Boy. Zero texture files. Zero sound files. Every building, weapon, face and sound is generated by code.” That is the creator’s account of how the game was made, not independent technical verification.
First also described his direction to the AI tools as wanting something “exactly like Fallout,” according to PC Gamer. The wording conveys the project’s intended resemblance; it is not, by itself, a legal admission.

Why was the project taken offline?
PC Gamer reported that ZeniMax Media told First that the fallout.nyc domain infringed its intellectual-property rights. Yahoo Tech separately reported that First posted an image that appeared to show a ZeniMax notice, with references to trademark infringement and copyrighted material. The project was taken offline following the reported contact.
The underlying notice has not been independently authenticated in the reporting cited here, and neither report establishes a court ruling or judicial finding that infringement occurred. The careful answer is that coverage attributes a rights-related notice to ZeniMax and says First took the project offline afterward—not that a court ordered the shutdown or found the game unlawful.

Why did PC Gamer’s Andy Chalk support the takedown?
The headline is Chalk’s opinion. He argued that the project’s close imitation of Fallout and its presentation did not warrant the sympathy often extended to fan projects, contrasting it with larger volunteer efforts. Readers can disagree with that judgment without confusing it with the reported facts: the creator’s account, the reported contact over the domain and the project going offline.
This episode does not establish that every fan game, AI-made game or noncommercial project is unlawful. It concerns this project and the reported rights dispute; the available coverage does not provide a general legal rule.

Can you still play Fallout: New York?
The cited coverage says the project went offline after the reported contact, but does not establish whether it is accessible today, whether copies remain elsewhere, or whether a later version exists. Treat current availability as unverified rather than assuming the game has vanished from every location.
What can you play instead?
Chalk’s article names the official games Fallout 3 and Fallout: New Vegas as alternatives. They are franchise releases rather than this fan project. The article’s Steam sale references were time-limited, so they do not establish current prices or availability; check the relevant storefront for present details.
