A counter notification is a legal request for reinstatement after a copyright removal—not a general appeal for every music claim—and should be filed only if you have a supportable reason to believe the removal was mistaken, misidentified, or covered by a copyright exception. Your other options may include asking the claimant to retract the request or completing Copyright School and waiting for the strike to expire.
First, identify whether YouTube issued a claim or a strike
Open YouTube Studio and read the exact notice; also check the enforcement email. A Content ID claim can monetize, track, or block a video. A copyright removal request is a legal request that can remove content and apply a copyright strike. The procedures are different: an appeal of a Content ID claim is not the same as a counter notification after content has been removed. See YouTube’s guidance on appealing a copyright claim and copyright removal requests.
Do not rely on the fact that the live broadcast was interrupted as proof that a strike was issued. YouTube says, “All live streams are scanned for matches to third-party content, including copyrighted content in the form of another live broadcast.” A match can interrupt a stream; if an active live stream is removed for copyright, YouTube says the channel may receive a strike and live-stream access may be restricted for seven days. Confirm the actual action in Studio and in the email. See YouTube’s live-stream copyright guidance and copyright strike guidance.
Gather the facts before responding
Before contacting the claimant or filing anything, record what YouTube identified and what it did. Preserve documents that could establish permission or explain why the removal may be wrong.

- Note the claimant’s identity, the exact song and recording named, the segment of the stream involved, and the notice’s description of the action.
- Save any licence, written permission, performance agreement, and related correspondence. Check whether the grant covers the relevant territory, platform, public performance or communication, livestreaming, and any archived recording.
- Keep a factual record of the stream’s context if you believe a copyright exception may apply—for example, whether it involved criticism, review, or reporting current events. Context alone does not establish that an exception applies.
A licence may not prevent an automated interruption: YouTube warns that licensed third-party content can still trigger one unless the rights owner adds the channel to its Content ID allowlist. Check the live-stream guidance linked above if you have permission but were still interrupted.
Credit to the artist, a consumer music subscription, a short excerpt, or a “no copyright intended” disclaimer does not by itself establish permission to livestream a song. Do not claim ownership or invent a licence. If your permission is disputed or the consequences are serious, consider getting advice from a qualified Indian copyright lawyer before filing a legal request.

Choose the response that matches your situation

When and how to submit a counter notification
YouTube describes a counter notification as “A counter notification is a legal request to reinstate content that was removed due to a copyright removal request.” It is not a routine way to contest an ordinary Content ID claim. YouTube says the original uploader should submit it, although an authorized representative, such as an attorney, may submit it on the uploader’s behalf. Read the current instructions in your account and YouTube Help: the available submission methods include Studio and, for videos, email, fax, or mail. Start with YouTube’s counter-notification instructions.
- Confirm the removal. Make sure Studio identifies a copyright removal request and removed content, rather than only a Content ID claim.
- Decide whether your grounds are supportable. You should genuinely believe the removal was mistaken or misidentified, or that a copyright exception plausibly covers the use. Do not file simply because the song was credited, the excerpt was short, or you disagree with the claimant.
- Read the disclosure and submission terms. YouTube forwards the counter notification to the claimant, so understand what information will be shared and the legal significance before submitting.
- Use the current process shown by YouTube. Follow the instructions available in Studio or YouTube Help for the removed video. Do not submit a Content ID claim appeal in place of a counter notification.
- Track the response period. After YouTube forwards the counter notification, the claimant has 10 US working days to provide evidence of legal action. If legal action is pending, the material remains down; otherwise, YouTube says it restores the material and removes the strike.
False information or misuse can have account or legal consequences. A counter notification does not guarantee reinstatement, and YouTube’s process cannot determine from the notice alone whether you own the necessary rights or qualify for an exception.

Retraction, strike expiry, and the two seven-day timelines
Requesting a retraction
You can contact the claimant shown in Studio and ask them to retract the copyright removal request. Keep the message factual, identify the relevant stream and notice, and explain the basis for your request. The claimant may decline or not respond; a request does not itself clear the strike.
Waiting for the strike to expire
YouTube says a copyright strike may expire after 90 days if you complete Copyright School and meet YouTube’s strike conditions. Expiry does not bring back the removed stream. Three copyright strikes within 90 days may subject the channel and associated channels to termination, so check all active strikes and their status. See YouTube’s strike guidance.

If YouTube sent a scheduled-removal notice
A scheduled-removal notice can give you a seven-day window to act before the content is removed and a strike is applied. This is separate from the possible seven-day restriction on live streaming after an active live stream is removed for copyright. If the removal has already taken effect, read the specific notice rather than assuming that deleting the content will clear the strike; the relevant options are determined by the enforcement status.

Section 51 addresses infringement where a person, without a licence or contrary to its conditions, exercises an exclusive right conferred on the copyright owner. Section 52(1)(a) provides for fair dealing with a work other than a computer program for listed purposes, including private or personal use, criticism or review, and reporting current events. These provisions do not create blanket permission to play a Hindi song in a livestream. Whether a particular use fits an exception depends on its facts and the rights involved.
A song may involve separate rights in the musical and literary composition and in the sound recording. The claimant’s identity in a notice does not, by itself, establish who owns every relevant right; equally, the available facts here cannot establish that the claimant lacks rights. Assess the specific recording, permissions, stream context, and notice before deciding whether to challenge.
Prevent a repeat without assuming a tool grants music rights
Whatever streaming setup you use, it does not create a licence for a song or guarantee that YouTube will not identify it. Confirm that your permissions cover livestreaming and the recording, and ask the rights owner about Content ID allowlisting where licensed music is interrupted.
