Content ID dispute reject होने का मतलब है कि claim कायम है—यह अपने-आप में न तो वीडियो हटने का संकेत है, न copyright strike. YouTube Studio में पहले देखें कि स्थिति केवल claim की है, appeal की, scheduled takedown की, या हटाए गए वीडियो पर strike की। आपके अगले कदम और जोखिम इसी पर निर्भर करते हैं।
पहले Studio में अपने वीडियो की स्थिति पहचानें
YouTube Studio में संबंधित वीडियो खोलें और Restrictions / Copyright विवरण देखें। claim, appeal, “Copyright – Pending takedown” और हटाए गए वीडियो पर लगी strike अलग स्थितियाँ हैं। यदि scheduled removal की सूचना मिली है, तो Studio और ईमेल में दी गई सटीक deadline देखें।
- केवल Content ID claim: dispute reject हुआ है और claim कायम है; वीडियो जरूरी नहीं कि हटाया गया हो।
- Appeal: appeal पर claimant को जवाब देने का अवसर मिलता है; आगे claim छूट सकता है, समाप्त हो सकता है या removal request आ सकती है।
- Pending takedown: निर्धारित समय के भीतर उपलब्ध विकल्पों पर निर्णय लेना है।
- वीडियो हटाया गया और strike लगी: हटाने के बाद का counter notification अलग कानूनी प्रक्रिया है, सामान्य Content ID appeal नहीं।
YouTube के अनुसार प्रारंभिक dispute और appeal की समीक्षा claimant करता है, क्योंकि YouTube ownership का निर्णय नहीं कर सकता। यह YouTube के platform workflow का विवरण है, भारत के कानून पर निष्कर्ष नहीं। YouTube का dispute मार्गदर्शन देखें।
अगर केवल dispute reject हुआ है: appeal से पहले आधार जाँचें
Claimant के पास Content ID dispute का जवाब देने के लिए सामान्यतः 30 दिन होते हैं। अस्वीकृति के बाद claim कायम रहता है और Studio में पात्र होने पर appeal का विकल्प दिख सकता है। Appeal तभी करें जब आपको सचमुच विश्वास हो कि आपके पास आवश्यक अधिकार हैं, उपयोग गलत पहचान के कारण claim हुआ है, या आपके उपयोग पर लागू अपवाद का ठोस आधार है।

अपने प्रमाण एकत्र करें
- दावे में पहचाने गए हर गीत, क्लिप या अन्य सामग्री का स्रोत और वीडियो में उसका समय-चिह्न।
- संगीत, फुटेज, ग्राफिक्स, गेमप्ले या प्रसारण के लिए लिखित अनुमति या लाइसेंस।
- लाइसेंस की शर्तें: अवधि, क्षेत्र, livestream, archive/VOD और monetization की अनुमति।
- यदि सामग्री आपकी है या गलत पहचानी गई है, तो मूल रिकॉर्डिंग या निर्माण का प्रमाण।
- यदि आप Copyright Act की धारा 52 के अपवाद पर भरोसा कर रहे हैं, तो उपयोग का उद्देश्य और लिया गया अंश कितना तथा किस तरह इस्तेमाल हुआ।
केवल credit देना, सामग्री की अपनी प्रति रखना या वीडियो से कमाई न करना अपने-आप में YouTube के बताए वैध dispute कारण नहीं हैं। Appeal eligibility या प्रक्रिया का दुरुपयोग चैनल पर असर डाल सकता है।
Appeal और तेज़ appeal विकल्प
Appeal पर claimant के पास जवाब देने के लिए 7 दिन होते हैं। वह claim छोड़ सकता है, जवाब न देकर claim को समाप्त होने दे सकता है, या copyright removal request भेज सकता है। वैध removal request से वीडियो हट सकता है और channel पर strike लग सकती है।
यदि claim वीडियो को block कर रहा है, तो कुछ मामलों में Studio में Escalate to Appeal विकल्प शुरुआती dispute चरण छोड़कर appeal शुरू कर सकता है। इससे प्रक्रिया जल्दी आगे बढ़ सकती है, लेकिन appeal खारिज होने पर takedown का जोखिम भी पहले आ सकता है। यह विकल्प हर claim में उपलब्ध नहीं होता—अपने वीडियो की Studio eligibility जाँचें।

Appeal के बाद scheduled takedown आए तो क्या करें
YouTube की scheduled removal सूचना में कदम उठाने के लिए सात दिन हो सकते हैं। Studio में दिखाई गई तारीख और deadline को प्राथमिकता दें। उपलब्ध विकल्पों में:

- deadline से पहले वीडियो हटाना;
- claimant से copyright removal request वापस लेने (retraction) का अनुरोध करना;
- यदि scheduled removal rejected appeal के बाद आया है, तो सात-दिन की अवधि में appeal रद्द करना। Appeal रद्द करने से strike टल सकती है, लेकिन Content ID claim वीडियो पर बना रहेगा।
यदि अवधि निकलने के बाद वीडियो हटकर strike लग जाती है, तो बाद में वीडियो delete कर देना strike नहीं हटाता।
वीडियो हट जाने पर counter notification कब विचार करें
Counter notification तभी विचार करने योग्य है जब वीडियो removal प्रभावी हो चुका हो और आप ईमानदारी से मानते हों कि removal गलती या गलत पहचान के कारण हुआ—उदाहरण के लिए, आपके पास अधिकार हैं या आपके उपयोग पर लागू अपवाद का मजबूत आधार है। यह साधारण शिकायत या Content ID appeal का अगला बटन नहीं, बल्कि कानूनी अनुरोध है।

YouTube के निर्देशों के अनुसार इसमें हटाए गए वीडियो का लिंक, संपर्क विवरण, पूरा कानूनी नाम और भौतिक पता देना होता है। YouTube यह जानकारी claimant को भेजता है। निजता की चिंता हो तो अधिकृत प्रतिनिधि, जैसे वकील, आपकी ओर से इसे जमा कर सकता है। गलत जानकारी या दस्तावेज़ न दें।
यदि YouTube counter notification को वैध मानकर claimant को भेजता है, तो claimant के पास 10 US business days में सामग्री रोकने के लिए कानूनी कार्रवाई का प्रमाण देने का समय होता है। ऐसा न होने पर वीडियो बहाल हो सकता है, जब तक uploader ने उसे हटाया न हो। यह YouTube की प्रकाशित प्रक्रिया की समयसीमा है، भारत की अदालतों में लागू कोई सामान्य limitation period नहीं। YouTube के counter-notification निर्देश पढ़ें।

अगर दावा सही है या आप निश्चित नहीं हैं
आप claimant से सीधे संपर्क करके retraction का अनुरोध या समाधान की बात कर सकते हैं। YouTube के बताए विकल्पों में claim को रहने देना, या वीडियो से claimed segment हटाना अथवा उसे mute करना भी शामिल है। यदि वीडियो हटाया गया है और counter notification का आधार नहीं है, तो YouTube Copyright School पूरा करने के बाद 90 दिन में strike expiry का विकल्प बताता है। लागू शर्तें Studio में जाँचें।

भारत में copyright कानून और livestream clips
भारत में “fair use” को हर परिस्थिति में लागू होने वाला सामान्य बचाव न मानें। Copyright Office के अनुसार Copyright Act, 1957 की धारा 52(1)(a) में सीमित fair dealing उद्देश्य शामिल हैं—निजी या व्यक्तिगत उपयोग (research सहित), criticism/review और current events/current affairs की reporting। इससे livestream में कोई भी copyrighted अंश इस्तेमाल करने की blanket अनुमति नहीं मिलती। संदर्भ, उद्देश्य, लिया गया हिस्सा और अधिकार या लाइसेंस की स्थिति मायने रख सकती है।
धारा 51 बिना लाइसेंस ऐसे कार्यों को infringement मानती है जो copyright owner के विशिष्ट अधिकारों में आते हैं। धारा 63 जानबूझकर infringement या abetment के लिए दंड का प्रावधान करती है। इन प्रावधानों से किसी खास creator के मामले का नतीजा तय नहीं किया जा सकता। YouTube का platform review और भारत की अदालत में कानूनी निर्णय अलग प्रक्रियाएँ हैं। Copyright Office का Section 52 विवरण, धारा 51 और धारा 63 देखें।
कब कानूनी सलाह लेना उपयोगी है
यदि आपको औपचारिक नोटिस मिला है, वीडियो से आपकी आजीविका या व्यवसाय जुड़ा है, लाइसेंस अस्पष्ट है, या counter notification में पता साझा करने को लेकर चिंता है, तो भारत में copyright/IP का अनुभव रखने वाले वकील से सलाह लें। पात्र जरूरतमंद लोगों के लिए NALSA और राज्य या जिला विधिक सेवा प्राधिकरण कानूनी सेवाएँ दे सकते हैं; पात्रता और उपलब्ध सहायता संबंधित संस्था से सत्यापित करें। NALSA Legal Services देखें।
