Generally, Nintendo treats Switch game ROMs shared through peer-to-peer networks or third-party download links as unauthorized copies, and says uploading or downloading pirate copies of its games is illegal. That is Nintendo’s position, not a complete answer for every country or every personal-backup situation. The legality can depend on how the file was obtained, whether security measures were bypassed, and which country’s law applies.
What does “Switch ROM” mean?
A ROM is a copy of a game’s data. An emulator is different: it is software that runs a program on a device it was not originally designed for. The legality of a game file and the legality of emulator software are separate questions; using one does not automatically establish the status of the other.
What does Nintendo say about downloading or sharing ROMs?
Nintendo of Europe says games offered through peer-to-peer networks or third-party file links are unauthorized copies. Its online piracy guidance states: “The uploading and downloading of pirate copies of Nintendo games is illegal.” Nintendo of America likewise says that pirating a game, or playing a pirated version, is against the law in its Intellectual Property & Piracy FAQ.
These are Nintendo’s official statements, not a country-by-country legal analysis. They do not establish that every situation involving a game file has the same legal result everywhere. Nintendo identifies the Nintendo eShop and Nintendo website as authorized places to buy authentic games.

Does owning the cartridge make downloading a ROM legal?
Not necessarily. Owning a physical copy does not, by itself, establish that downloading the same game from an unrelated site is authorized. The sources cited here do not resolve the legal treatment of every personal-copy or backup scenario, and they do not establish that ownership permits bypassing technical protections. The method used to obtain or copy the file and the law in the relevant country matter.
Are Switch emulators illegal?
Nintendo defines emulators as programs that let software run on a device it was not originally created for. Its emulator guidance says unauthorized emulators can encourage the use of pirate copies and that some unauthorized emulators circumvent game security and are unlawful. It does not say that every emulator is automatically illegal. Whether a particular emulator or its use is lawful depends on the circumstances and applicable law.

Why do security measures matter?
Circumvention is a separate issue from simply possessing an emulator or a game file. Nintendo describes circumvention products as devices or software that bypass its security measures to make unauthorized copies, modify game files, or play games in unauthorized ways. Nintendo says importing, marketing, selling, or distributing these products is illegal, and says using them to play unauthorized copies is unlawful. These are Nintendo’s claims; the legal result in a particular case depends on jurisdiction.
Nintendo also warns that unauthorized circumvention products may damage a console, affect warranty coverage for damage they cause, reduce functionality such as online play, or stop working after network updates. Those are product-risk warnings from Nintendo, not a guarantee that every device or console will experience those outcomes.

What is the safer way to get a Switch game?
Use Nintendo’s eShop or Nintendo website to purchase authentic games. If buying elsewhere, verify that the seller and product are authorized rather than assuming a third-party listing is legitimate. Avoid sites offering unauthorized game files and products designed to bypass console security.
