Fallout 4 Season Pass Lawsuit: What the Court Actually Decided

The Fallout 4 Season Pass lawsuit alleged that promised DLC was missing, but the 2022 court ruling ordered arbitration rather than deciding the claims. Microsoft completed its ZeniMax acquisition in 2021.

A lawsuit over Fallout 4’s Season Pass did not establish that Bethesda broke its promise to provide all downloadable content. On October 21, 2022, a federal judge ordered the dispute into arbitration and stayed the court case; the ruling did not decide the claims’ merits or certify a class. Microsoft’s acquisition of Bethesda parent ZeniMax, once described as looming, was completed in 2021.

What the Fallout 4 Season Pass lawsuit alleged

In Devine v. Bethesda Softworks, LLC, Jacob Devine alleged that the Fallout 4 Season Pass was presented as providing access to “all” Fallout 4 downloadable content “for one S.P.E.C.I.A.L. price.” He claimed he did not receive all the content he expected. Those statements describe allegations in the complaint, as recounted by the court—not findings that Bethesda misrepresented the offer or breached a contract. The October 21, 2022 court opinion says Devine bought Fallout 4 at GameStop shortly after its November 2015 release and purchased the Season Pass through the Xbox Games Store/Microsoft Store on April 27, 2019.

Filed on July 9, 2019, the suit sought damages for Devine and other purchasers who allegedly did not receive all Fallout 4 downloadable content. It asserted nine claims:

  • Breach of contract
  • Unjust enrichment
  • Promissory estoppel
  • Fraud or deceit
  • Fraudulent concealment
  • Negligent misrepresentation
  • A tort arising out of breach of contract
  • Breach of express warranty
  • Violation of the Maryland Consumer Protection Act

Listing these claims does not mean the court found that any was proved.

Did the Season Pass include all Fallout 4 DLC?

The court opinion does not answer that question. It recounts Devine’s interpretation of the Season Pass offer and his allegation that he did not get all the content he expected, but it does not rule on whether that interpretation was correct or whether Bethesda violated the offer. The 2022 decision concerned arbitration, not the Season Pass’s scope or the merits of the consumer claims.

What the judge decided—and what remains unresolved

On October 21, 2022, U.S. District Judge Paul W. Grimm granted the defendants’ motion to compel arbitration. The order stayed and administratively closed the court case pending arbitration, required joint status reports every 180 days, and deferred Devine’s motion under Federal Rule of Civil Procedure 23(d) while the stay remained in place. The ruling addressed the arbitration agreement and who would decide arbitrability; it did not determine liability or damages.

The lawsuit was filed as a putative class action, meaning Devine sought to bring claims on behalf of a proposed group. The located ruling did not certify a class. It also does not establish what happened in arbitration afterward or whether there was a later court disposition. Accordingly, the opinion is not evidence that Bethesda lost, that the claims were dismissed or settled, or that the dispute produced a class-wide outcome.

Microsoft’s acquisition of Bethesda’s parent company is complete

Microsoft announced its plan to acquire ZeniMax Media, the parent company of Bethesda Softworks, on September 21, 2020. It announced completion on March 9, 2021. The deal is historical context for the original headline, not a pending takeover. Microsoft’s September 2020 announcement described the planned acquisition; its March 2021 announcement confirmed completion.

Why Fallout 4’s platform details matter here

The opinion describes Fallout 4 as available for Windows PC, Xbox One, and PlayStation 4, while Devine’s account involved an Xbox One copy and a Season Pass purchased through Microsoft’s store. Those details identify the context of this particular dispute; they do not establish that the same purchase history or platform applies to every Season Pass buyer.
